A Brief Primer on Auto Insurance Companies and “Budget” Insurance Provider Amounts
We have a few words about the liability insurance business in general. If you’ve never had to deal with one, you haven’t experienced their greedy practices first-hand. And you’re in for a surprise. Contrary to their commercials and public relations campaigns that assure you that claims are happily paid, the real story is that most insurance companies are in the business to make money off their policyholders and payout as little as possible in claims. They have many ways of doing this.
But at the bottom end of the auto liability food chain are the “minimum coverage providers.” You see these guys on television a lot, and at all hours of the day or night, marketing their “affordable” auto insurance services to you. If you’ll look at the fine print in their ads, you’ll notice they are required to tell you the state in which their corporate offices are. Remember this point as it could become very important in your particular case.
Minimum Texas auto insurance coverage’s are known as “30/60/25.” Each number is in thousands. The 30 (thousand) is for bodily injury per-person: the 60 thousand covers bodily injury per accident (as in the total amount paid for all bodily injuries per-accident). And the 25 thousand covers property damage (the value of the vehicle and all its contents) to the insured motorist and the vehicle he or she hit. But the average price of most cars on the road for three years or less is seldom less than $25 thousand. Notice there are no explicit requirements to pay for an injured victim’s pain and suffering or lost wages or survivor damages if anyone is killed in the accident. So just because the money is theoretically available through the negligent driver’s policy doesn’t necessarily mean that you will be able to easily recover it the value of your damages and other losses if the negligent driver carries minimum coverage.
But it’s easy to sign-up for minimum coverage auto insurance. Just go to the payment portion of the insurance company’s secure Web site, give them your credit card number, print-out your “proof of (minimum) coverage” document, and “voila.” You’re “street legal.” But make that “low” payment every month or your coverage is dropped. And sometimes, if you try to go back and re-up your account, it might cost a few dollars more. Or maybe you allow them to “dip their hand” in your bank account monthly; but the day they do, you don’t have enough to pay. Guess what? You’re dropped. Repeat the re-purchase process or go to some other “budget” insurer and repeat THAT same process. Those who get their auto insurance this way can be referred to as “gypsy policyholders.” And unfortunately, so too can some of these companies. They can open and close their doors at a moment’s notice. What happens if a couple of these “gypsies” are the ones who pay your insurance. And what happens if you’ve fallen into that coverage trap yourself?
An experienced local attorney with our Law Firm will analyze your case, and explain your options so that you will fully understand them. We want to make certain that you recover as much as reasonably possible for your injuries and make this sometimes complicated legal process as easy as for you to understand and navigate to a successful end. Other Insurance Tactics That Are Designed to Thwart your Legal Compensation Rights
Insurance companies can be extremely difficult to negotiate with. They are frustrating to get any money out of, much less a straight story. Why waste your time and patience? Let your lawyer deal with the insurance companies that are out to protect their own interests. And as we said, those interests involve collecting premiums and paying out as little as absolutely necessary.
They’ll use adjusters to try and deny your claims. Sometimes they may call you repeatedly, asking innocent-sounding questions about your accident and what you did. They may seem harmless, but they’re usually calculated to provoke you into saying something that would be used against you to deny your claims. Whatever you say to them will certainly be recorded and could come back to haunt you as evidence against your claim in the future. And for your information, in Texas the insurance companies can record them without your permission, or even your awareness.
The accident injury clients at our Texas Law Office have learned from us the best way to deal with insurance adjusters: ignore them. Adjusters don’t call our clients. We make them call us instead. When adjusters can’t talk to you, they don’t have a chance to twist your words around and use them to hang you.
Many times an insurance company usually pressures you to settle your lawsuit for less than your claim is worth. Sometimes it’s much less. Now we believe accepting a fair settlement offer can be beneficial for an accident victim. But accepting an unfair settlement offer can be devastating for your legal rights. When you accept a settlement offer, you permanently give up your right to sue the defendant for more. It’s all that you will ever collect. So it’s important not to accept an offer unless it’s fair. And the only way to determine a fair settlement from an insurance company that wants to victimize you is with the assistance of an auto accident attorney.
Don’t let the underinsured defendant (or your insurance company if the defendant is underinsured) get away with paying you less than you deserve for your auto accident claim. Call our auto accident lawyers to learn what your case is really worth so that you know whether or not the defendant’s insurance company’s offer is truly fair, or merely the minimum amount they think your claim is worth to settle.

How to Choose the Auto Accident Injury Lawyer who’s Right for Your Case: even in Accidents Involving UI/UIM disputes.
If you have been in a car accident in our community involving a UI/UIM negligent driver, you need to contact an attorney who can give you the best results possible. Our experienced car accident lawyers suggest that you speak with two or three attorneys before deciding on the one to handle your case. When consulting with one, ask about experience in handling UI/UIM cases similar to yours and make sure to discuss this lawyer’s record in litigating and settling similar car accident cases. Also ask the attorney if they’ve dealt with the insurance companies involved and what were the results. Ask them also to provide you with a few names and contact information of a few former clients with cases similar to yours. And then call them. Do not hire the attorney unless you trust him or her and are confident in their ability to represent you in a way that you are comfortable with.
The uninsured auto accident attorneys with our Law Firm have been handling car accident litigation for over 30 years. We’ve won favorable verdicts and negotiated fair settlements against nearly every major auto insurer in the state. Our business is making sure that you recover as much as possible for your injuries and simplify what, to many, is a complicated, often dubious legal process.
The time after a car accident is often stressful and confusing to the victims. And if insurance compensation is up-in-the-air, it can be even more frightening to you and your family. Don’t add to the stress and confusion by letting an inexperienced attorney handle your case, or represent yourself when you are clearly unqualified to look out for your (or your family’s) best interests. We are uniquely qualified and fully prepared to get you the best results possible. If you or someone you know were injured in a car accident, contact an attorney at our Texas Law Office today for a free consultation and find out how we can help you.
