Texting While Driving

Distracted driving has been a problem for many years throughout the country, but in recent years, texting and driving has become a serious issue. Several years ago, Texas banned texting while driving. Individuals who are caught reading or sending text messages while they are operating motor vehicles will be subject to tickets and fines. Despite the ban, however, people still continue to text and drive, and when they do so, their actions sometimes lead to accidents.

Driver distraction, particularly texting and driving, is a common cause of vehicle accidents. Reading or replying to a text while driving causes an individual to take his or her eyes off the road, which is dangerous for both the driver and others on the road.

If you have been hurt in an accident that was caused by someone who was texting and driving, you may be entitled to compensation for your injuries. Let one of our skilled car accident attorneys evaluate your case. Call us toll-free or email us today for more information.

The Dangers Of Texting While Driving
Studies have shown that drivers who text while driving can be even more dangerous than drunk drivers. For example, a study that was done by researchers at the Virginia Tech Transportation Institute revealed that whenever drivers text while driving, their risk of having an accident is 23 times higher than when they aren’t texting. The study also showed that drivers who are texting while driving often spend the last seconds immediately preceding an accident looking at their cellphones instead of the roadway.

The law in Texas is clear – it is illegal to text and drive. This means that even if an individual is stuck in traffic or sitting at a red light, he or she cannot take that time to pick up the phone and read or send text messages.

The Possible Results Of Texting While Driving
Drivers who act carelessly and irresponsibly by sending and viewing texts while driving should be held responsible for any harm they may cause. It is important for accident victims to work with skilled lawyers who can investigate the accident and gather all the appropriate evidence needed to prove the case.

An accident that involves texting while driving can be even more devastating than other types of accidents because the driver typically isn’t focused on applying the brakes in order to lessen the impact of the crash. In fact, studies have shown that a texting driver’s reflexes and reaction times are just as slow as a drunk driver who might cause a drunk driving crash. The results of such accidents can lead to broken bones, serious internal injuries, or even death.

Cellphone Carriers Unite
Even cellphone companies, like Verizon Wireless, AT&T, Sprint, and T-Mobile, recognize that texting while driving is a serious issue in the U.S., and accordingly, some have launched ad campaigns geared toward dissuading individuals from using their cell phones while driving. As a matter of fact, the Department of Transportation refers to texting and driving as an “epidemic.”

Regardless of what it’s called, texting and driving is a dangerous activity that can have life-changing results for accident victims and their families.

Reckless Driving And Speeding

Reckless driving and speeding are two common causes of vehicle crashes. Depending on the circumstances, speeding can be deemed to be a type of reckless driving that can lead to devastating injuries or even death. However, reckless driving includes many other aspects of driving besides speeding.

A reckless driver is anyone who drives dangerously without regard for the safety of others. A driver can be reckless by changing lanes in an aggressive manner, cutting off other drivers on the roadway, and/or tailgating. Much like drivers who text while driving, when individuals drive in such a reckless manner, accidents can occur.

Motor vehicles are a primary mode of transportation for many people who travel in and around the state. Those who operate motor vehicles in the area are required to abide by city and state laws. When drivers disregard those laws, they put other people’s lives at risk and drastically increase the likelihood of an accident occurring.

If you have been injured in a motor vehicle accident that was caused by another person’s reckless driving or speeding, contact one of our knowledgeable car accident attorneys to discuss your options. Call us toll-free or email us today for a consultation.

Reckless Driving And Speeding Can Lead To Serious Injuries
Realistically, many people drive a few miles over the posted speed limit on a regular basis, but exceeding beyond just a few miles over the posted speed limit can create hazards. Likewise, some individuals frequently change lanes in traffic in an effort to get to their destinations a little quicker than the current traffic conditions will allow. However, such driving techniques can lead to horrific accidents that cause substantial injury or death.

Some of the possible injuries that accident victims might sustain include:

Spinal cord injuries
Abrasions and bruises
Head and brain injuries
Some victims might also face very serious disabling injuries that might be temporary or permanent. That said, it is important for those who have been hurt in accidents that were caused by someone else’s reckless driving and speeding to seek legal counsel from well-versed lawyers who can provide more insight with respect to the facts of their particular cases.

What Constitutes Reckless Conduct While On The Road?
Along with the techniques noted above, there are several other driving tactics that can be deemed as reckless driving. For instance, in addition to speeding, some people drive too fast for the conditions of the road. If the roads are wet or a driver faces foggy conditions, he or she may need to drive much slower than normal in order to avoid a possible accident.

Another issue that can lead to reckless driving and speeding is “road rage.” Road rage is a condition where a driver has an emotional reaction while driving that can result in erratic and unpredictable behavior which may endanger other motorists. Road rage can occur in even the most mild-mannered drivers, especially if they are stuck in traffic and running late for an appointment. Road rage leads to aggression, and that aggression can lead to a serious accident.

If you or someone you love has been involved in a motor vehicle accident that was caused by someone driving in a reckless manner, you may be entitled to compensation. Discuss your case with one of our skilled lawyers today. Call us toll-free or email us to schedule an appointment.

Defective Car Parts

In the U.S., automobile accidents take place every day, and those accidents can occur for any number of reasons, such as texting while driving. Many accidents happen because of driver errors; however, some motor vehicle accidents happen because of errors made during the manufacturing process. Defective car parts have played a role in many car accidents across the country.

According to the National Highway Traffic Safety Administration, the auto industry recalled just about as many vehicles as it sold. That is an astounding fact that demonstrates a large number of vehicles out on the roadways today that are defective or have defective car parts. Defective car parts can cause vehicle crashes that can change the lives of those involved.

If you have been involved in a car accident that was caused by a defective car part, contact one of our knowledgeable car accident attorneys right away. Call us toll-free or email us to discuss the facts of the case.

Defective Car Parts Can Lead To Devastating Injuries
Defective automobiles can lead to a variety of problems. For instance, some defective parts can actually cause an accident to happen or hinder the proper prevention of an accident. Examples of defective car parts that can lead to automobile accidents are:

Defective tires, which can experience tread separation that might lead to blowouts on a highway
Brakes
Accelerator pedals might become stuck when depressed, which can lead to unintended acceleration and vehicle crashes
Serious injuries can happen when certain auto parts malfunction. Some examples may include defective seatbelts or airbags. Automobile manufacturers are required and expected to put their motor vehicles through meticulous testing prior to selling them. That said, it is important to hold responsible the manufacturers and other parties involved for any accidents that may occur because of their actions or inactions.

What Must You Do To Prove The Existence Of A Defective Car Part?
First of all, anyone who is considering taking on an automaker or car part manufacturer should not attempt to do so alone. Manufacturers have teams of lawyers working for them; therefore, it is important for any accident victim who believes that he or she has been hurt because of a defective car part to contact an area attorney as soon as possible.

A skilled car accident attorney can look over the facts of the case and make a proper assessment regarding the viability of the case. In a defective car parts case, it is very important that the vehicle at issue is preserved as-is and taken in for a full inspection after the accident. The vehicle is the most important part of the case, so make sure that the vehicle remains in the same condition that it was at the time of the crash is crucial.

If the vehicle has been properly preserved, an expert can perform an analysis that will show the existence of defects and malfunctions in the vehicle, and such a showing can prove to be very beneficial for the case.

If you or a loved one has been hurt in an accident due to a defective car part, you may be entitled to damages. Contact one of our skilled lawyers today to learn more about your legal options. Call us toll-free or email us to schedule an appointment.

Dangerous Roads

Much like reckless driving and speeding, dangerous roads are a factor in many of the car accidents that occur all across the nation. Thousands of people have died as a result of crossing over the center lane, dropping down a slope, or crashing into still objects, such as light poles or walls. While it is true that such accidents can occur for a variety of reasons, one often-overlooked car accident cause is the presence of dangerous roads.

Dangerous roads can be the result of several things, such as bad road design or poor construction and maintenance. When a dangerous road hazard exists, the possibility of an accident may increase. For instance, a dangerous curve in a roadway can cause the driver of a vehicle to either cross over into the opposite lane and crash into an oncoming automobile or run off the roadway and roll over.

Individuals who have suffered injuries in an accident caused in part or in total by a dangerous road condition should contact one of our skilled car accident attorneys as soon as possible. Call us toll-free or email us today to discuss the particulars of the case.

What Types Of Dangerous Road Conditions Can Cause An Accident?
Heavily populated areas are often congested with motor vehicles, pedestrians, and cyclists. A large number of people on congested roadways can make for a dangerous situation on its own; however, the situation worsens when the roadways at issue are poorly designed and inadequately maintained.

There are many types of dangerous road conditions that can lead to automobile accidents, such as:

Dangerously short exit ramps that don’t allow for drivers to safely merge onto the roadway
Pavement that has poor skid resistance
Improper drainage can lead to ponding on street surfaces and hydroplaning
Poor street/highway construction
Potholes, a lack of guardrails, and missing and/or deteriorated signage
Certain roads become dangerous due to poor visibility caused by low-hanging or overgrown vegetation, a lack of reflective markings that can be seen by drivers after dark, and an inadequate amount of shoulder space.

What Should An Accident Victim Do If An Accident Occurred On Known Dangerous Roads?
One of the first things that an accident victim should do, regardless of the type of accident, is seeking medical attention. Once proper medical attention has been obtained, the accident victim should consider contacting a knowledgeable car accident lawyer as soon as possible after the accident because timing is crucial and the preservation of evidence is vital.

Having a lawyer handle a dangerous road case is very important because quite often, such cases involve governmental entities that receive certain levels of immunity when it comes to lawsuits. That said, an attorney can be beneficial to the case because he or she can hire relevant experts and conduct a thorough investigation that might reveal certain facts that can defeat the government’s immunity defense.

If you have been involved in a motor vehicle accident and you believe that the accident may have been caused by a dangerous road hazard, help is available to you. Contact one of our capable lawyers today. Call us toll-free or email us to schedule a consultation.

Some of the injuries suffered might be minor; however, some of the injuries might be very serious. Common car accident injuries that some accident victims might experience include cuts, bruises, strains, sprains, and back injuries.

The cuts and bruises that an individual might suffer during a motor vehicle accident will likely heal within a short period of time. However, accident victims who incur back injuries may experience long-lasting pain for years to come. Spinal cord injuries that can lead to paraplegia or quadriplegia
Bulging or strained back disks
Herniated disks
Lumbar strains
Depending on the nature of the injury, some motor vehicle accident victims who suffer injuries to the back recover within a year or so of the accident; however, some back and spine injuries do not heal as quickly, if at all. Long-term injuries lead to increased medical bills that can become overwhelming. Therefore, accident victims who are dealing with accident-related back issues should consider seeking the advice of legal counsel in order to find out if any legal remedies are available to them.

According to the Centers for Disease Control and Prevention, motor vehicle accidents cause approximately 30 percent of the traumatic brain injuries that occur every year throughout the U.S. A brain injury can be very serious. In fact, it is one of the most devastating injuries that an accident victim can experience.

Much like other types of vehicle accident injuries, brain injuries can have a major impact on the lives of the victims and their families. Such an injury can require ongoing medical treatment and care, which can be a substantial burden on the victim and his or her loved ones. However, accident victims do not have to face their medical and financial challenges alone. Help is available.

What Is A Traumatic Brain Injury?
A traumatic brain injury is typically the result of a serious blow or hard impact to the head. However, such injuries can also occur without direct impact, as in cases of fast acceleration or deceleration. If an accident victim experiences any sort of head trauma in an accident, he or she should seek medical attention right away.

Some car accident victims might face what is known as mild traumatic brain injuries after a vehicle accident occurs. These injuries typically don’t require surgery, but they can have a serious impact on a person’s cognitive and social abilities.

The Signs And Symptoms Of Brain Injuries
All injuries to the head and to the brain are not created equal. The signs and symptoms of brain damage can vary depending on the sex and age of the accident victim, the side of the brain on which the injury occurred, and whether or not the individual sustained additional injuries during the motor vehicle accident. Symptoms can also vary based on the nature of the impact.

Some of the common symptoms of traumatic brain injury include:

Physiological issues, such as nausea, vomiting, and loss of motor functions
Psychiatric issues, such as post-traumatic stress, anxiety, and depression
Physical issues, such as nose and ear drainage and dilated pupils
Cognitive issues, such as slurred speech, visual impairments, and attention deficit issues
Additional symptoms include loss of or impaired hearing, confusion, and an inability to sleep. Accident victims who are experiencing any of the above-mentioned symptoms should seek medical help right away if they haven’t already done so.

The Effects Of Brain Injuries
Identifying and diagnosing a traumatic brain injury can be difficult, even for physicians who specialize in brain injuries. Brain injuries carry major consequences for accident victims and their families. Undoubtedly, accident victims who have suffered brain injuries will face high medical costs for things such as medication, rehab, and other treatments that may be necessary. Head Injuries

Automobile accidents can cause head injuries that are not immediately realized at the time of the accident. Unfortunately, because head injuries may not become apparent until hours or even days after the occurrence of an accident, they can go undiagnosed and untreated. Therefore, it is crucial for a car accident victim to be seen by a physician as soon as possible after an auto accident. Although everything may “seem” fine on the outside, the inner workings of the head may tell a different story.

Although certain federal agencies compile statistics with respect to the number of motor vehicle accidents that occur and the number of people who are injured or killed in those accidents, information regarding the exact number of injuries to the brain and head that result from motor vehicle accidents is not readily available. Nonetheless, some statistics indicate that automobile accidents are the leading cause of all head injuries.

If you or a loved one has sustained a head injury that was caused by an automobile accident, contact one of our knowledgeable car accident attorneys as soon as possible. You may be entitled to compensation. Call us toll-free or email us to discuss your case.

Head Injury Classifications
The human head and brain are complex organs. The brain not only controls an individual’s thoughts but also controls a person’s actions. Consequently, many things can go wrong when the head and brain sustain injuries.

Head injuries are generally placed into two classifications:

Open head injuries
Closed head injuries
Open head injuries occur when an object penetrates the skull. For instance, in a motor vehicle accident, an accident victim might sustain an open head injury if he or she goes through the windshield and some of the glass cuts through the skull.

Closed head injuries occur when an individual sustains a hard blow to the head, but that blow does not penetrate the individual’s skull. For example, an accident victim might experience a closed head injury if the victim hits his or her head on the steering wheel, dashboard or any other hard surface in the vehicle during the accident.

Anyone who suffers either class of head injuries might face long-term brain damage; therefore, it is crucial for accident victims who experience such injuries to receive immediate medical diagnosis and treatment.

Possible Causes Of Head Injuries
Head injuries can occur in a number of ways; however, in automobile accidents, determining what caused an accident victim’s head injury might be a difficult task. For instance, some car accident injuries that involve the head and brain might occur during the deployment of an airbag. Likewise, a head injury might occur if a vehicle’s seat belts were defective at the time of the accident and malfunctioned, thus allowing the individual to be thrown from the vehicle.

If you or a family member has been in a motor vehicle accident that resulted in head injuries, contact one of our capable lawyers to find out whether you are eligible to receive compensation from the individual or individuals who caused the accident. Neck Injuries

Automobile accidents can lead to all types of auto accident injuries. The severity of those injuries will vary based on the level of impact experienced during the accident. One injury that is common in vehicle accidents is a neck injury. Neck injuries, much like injuries to the back, have varying degrees of severity, and the pain felt after sustaining such injuries can be long-lasting.

Car accident victims can experience neck injuries in a number of ways. For instance, rear-end collisions, side impacts, and head-on collisions can jostle the head, neck, and back in a way that can lead to serious injuries. When such accidents happen, the driver and his or her passengers will likely need medical treatment, and some of the treatments can be very expensive. Some accident victims, however, may be entitled to financial compensation from the party or parties responsible for the accident.

If you or a loved one has sustained neck injuries from a motor vehicle accident, contact one of our car accident attorneys today. You may be entitled to receive compensation for your injuries. Call us toll-free or email us to discuss your case.

Whiplash
Whiplash is a slang term often used to describe a neck injury that is common to a rear-end accident. The neck and spine can be damaged in a crash due to the amount of force that results in rear-end and side-impact crashes. An individual’s neck can be “whipped” to the front, back, or side while his or her head remains in place after impact, and the injuries that can result from that extreme jerking motion are what’s commonly referred to as whiplash.

Some people mistakenly believe that whiplash-type injuries can only be sustained after major high-speed crashes, but that is not true. In fact, whiplash commonly occurs in low-impact, rear-end accidents.

Types Of Neck Injuries
Sometimes when motor vehicle accidents occur, individuals try to “brace themselves” for the impending impact. But even when people brace themselves, they can’t really stop their necks from jostling. Such jostling can lead to certain soft tissue injuries in the neck that can vary in severity. There are two types of whiplash-like injuries that a person might experience:

Sprains, which generally refer to injuries to the ligaments in the neck
Strains, which refer to injuries to the muscles and tendons in the neck
Additionally, there are three levels of strains and sprains: mild, moderate, and severe. Whenever an individual injures his or her neck tissues, the individual might experience pain and some loss of movement, but not in the arms. However, when a person experiences injuries to the nerves in the neck, he or she can have arm pain, numbness, and weakness.

Symptoms And Treatment For Neck Injuries
After the occurrence of a motor vehicle accident, individuals might notice some common signs of neck injuries. For example, some people might experience neck pain and stiffness, headaches, dizziness, and blurred vision.

Some neck injuries can be treated with certain chiropractic methods. Regardless of the method chosen to treat neck injuries, individuals should start receiving treatment as soon as possible.

If you or a family member has suffered neck injuries from a vehicle accident, you may be entitled to financial compensation. Contact one of our skilled car accident lawyers by calling us toll-free or you can email us today to schedule a consultation.

Fatal Car Accidents

When people get into their motor vehicles, they generally expect to reach their final destinations safely. No one ever plans to be involved in a car accident, but accidents do happen. The accidents that take place can range from pedestrian accidents to tractor-trailer accidents. Such accidents can cause a range of auto accident injuries; however, some of the crashes that occur in the city are fatal car accidents. The loss of a family member or loved one in a motor vehicle accident can be one of the greatest tragedies that a person ever experiences.

If you have lost a loved one in a fatal car accident and you have questions about your legal rights, allow one of our skilled car accident attorneys to help you. Call us toll-free or email us as soon as possible to discuss the details of your case.

Types Of Fatal Car Accidents
Fatalities can occur in various types of accidents. For example, many alcohol-related crashes can result in fatalities. Likewise, lives can be lost in:

Intersection accidents
Cab and limousine accidents
Commercial truck accidents
Intersections are often places where drivers use poor judgment and make costly mistakes that can lead to injuries of the neck and head or even death. In fact, the Driving Institute of America reported that more than 40 percent of all motor vehicle fatalities involved drivers who failed to yield the right of way.

With respect to cab and limo accidents, passengers should be aware that they have rights if the vehicle is involved in an accident. Similarly, those who have lost family members or loved ones in such accidents might also have a right to recover from the loss of those individuals.

Any individual who has lost a loved one because of an accident that involved a commercial truck is encouraged to speak with a skilled accident lawyer as soon as possible because there are a number of factors to consider in such cases. No matter the type of fatal car accident, it is important that family members realize that, in many instances, they have rights with respect to seeking just compensation from those who caused the accident.

Wrongful Death Actions
A family member or personal representative of the deceased individual’s estate can file a wrongful death action against the party or parties who were responsible for the loved one’s death.

Under Texas law, in order to succeed in a wrongful death suit, the family member or representative must demonstrate that the deceased was killed due to someone else’s misconduct or negligence. Additionally, grieving family members should keep in mind that they must file a wrongful death lawsuit within a certain period of time; otherwise, they may lose their rights to recovery.

If you have lost a family member in a fatal car accident of any kind, contact one of our competent accident lawyers as soon as possible because time is of the essence. Call us toll-free or email us today to schedule an appointment.

Do I Have A Case?

Once car accident victims deal with the shock and anguish that can occur after crashes, they might start to develop questions about liability. For example, a victim who was hit by a truck driver might wonder whether or not there are others beyond the driver who can be held responsible for the injuries suffered. However, while this is a valid question, one of the first questions that a victim should ask is, “Do I have a case?”

Determining whether or not an accident victim has a viable case can be tricky. There are many factors involved in making the determination. That is why it is best for individuals who have been involved in motor vehicle accidents to speak with well-versed car accident attorneys prior to making any decisions on their own.

If you or a loved one has been involved in a car accident and you want to know if you have a case, contact one of our capable lawyers today to discuss the facts of your case. Call us toll-free or email us for more information.

How To Determine If You Have A Case
Car accidents can happen for any number of reasons. However, quite often, motor vehicle crashes occur because one or more drivers were negligent in some way with regard to the operation of the vehicle. Among the many things you need to know, you should know that drivers who operate motor vehicles have an obligation to use reasonable care when driving their vehicles.

If a driver fails to use reasonable care, he or she might be held responsible for any injuries or damages suffered in an accident. When an accident victim is determining if he or she has a case, one of the first things to consider is whether or not another driver was negligent.

Factors To Consider When Assessing The Viability Of A Case
Prior to making the final decision to sue an individual or entity for damages, accident victims should keep in mind that a number of factors should be taken under consideration first. Some of the factors for consideration include:

Possible legal strategies
Favorable and unfavorable elements in the case
Likelihood of a settlement
With respect to possible legal strategies, a lawyer who typically handles car accident cases will likely have an idea of what strategies will work and what strategies won’t work based on the facts of the case.

If an attorney sees certain obstacles in the case that can’t be defeated, he or she may advise the accident victim to forego pursuing a lawsuit and work towards obtaining a settlement instead, particularly if more obstacles exist than favorable elements. Working with your auto insurance company can be a tough task, but a skilled attorney will already be aware of the common tricks and tactics that insurers typically use.

Do You Have A Case? Let A Lawyer Advise You
It is always a good idea for accident victims to work with skilled lawyers with respect to their car accident cases. A lawyer can let victims know whether or not pursuing lawsuits or obtaining settlements would be in their best interests.

The first thing you should know is that if you were hurt in a car accident caused by someone else’s negligence, you may be entitled to financial compensation for both your economic and non-economic losses.

Regardless of whether the injuries incurred were minor or severe, the person or entity responsible for the accident is obligated to make the accident victim financially whole again. That being the case, it is important for accident victims to have an idea of how much a car accident settlement is worth prior to reaching any agreements with the responsible party or parties.

If you or a loved one has questions about the potential value of your car accident settlement, contact one of our skilled car accident attorneys immediately. Call us toll-free or email us as soon as possible to discuss the case.

How Much Is A Car Accident Settlement Worth? Depends On The Strength Of The Liability Claim
In order for a car accident victim to recover monetary compensation for the injuries suffered, he or she must show that the other driver was negligent or careless while operating the motor vehicle. This means that the victim will be required to prove that the other driver failed to use reasonable care, and that failure was what caused the accident that brought about the injuries.

There are a number of driver actions that can constitute negligence, such as:

Tailgating or following too closely
Driving too fast for the road conditions
Disobeying traffic signs and signals
Texting or using a cellphone while driving
Having evidence to demonstrate any of the above actions will be crucial to the case. However, many accident victims don’t know what they should do after a car accident, and their lack of knowledge might cause them to lose valuable pieces of evidence.

The Extent Of Damages Will Be Important To Determining How Much A Car Settlement Is Worth
If liability exists, the only thing left to figure out is how much monetary compensation is appropriate based on the extent of the injuries sustained. Insurance adjusters generally gather various pieces of information regarding the severity of the injuries, the amount of medical care needed, and the overall prognosis prior to making a settlement offer.

Some insurance companies use a special computer program to formulate a settlement offer; however, some insurers may choose to calculate the amount of the accident victim’s medical bills, lost wages, and other accident-related expenses.

Occasionally, insurers will need to consider additional factors. For example, if an accident victim was responsible for taking care of a child or an elderly relative prior to the occurrence of the accident, the accident victim may need to hire a caregiver to manage those responsibilities. This, and several other things, should be taken into account before making a final settlement offer.

If you or a family member has been hurt in a motor vehicle accident and you have concerns about how much your settlement might be worth, allow one of our car accident lawyers to help you. Call us today toll-free or email us to schedule an appointment.

Do I Need A Lawyer For A Car Accident?

Do I have a viable case? What should I do next? These are both common questions that car accident victims typically ask. However, there is another question that some victims grapple with after they’ve calmed down and taken time to evaluate their situations, and that question is, “Do I need a lawyer for a car accident?”

The answer to the question will depend on the facts and issues involved in the case. However, you will need to consider several things before making a final decision with regard to whether or not you need a lawyer for a car accident.

If you or a loved one has been hurt in an automobile accident, you may have questions about your need for a lawyer. Speak with one of our knowledgeable car accident attorneys about your case before making a final decision. Call us toll-free or email us today to discuss your options.

How Will I Know If I Need A Lawyer For A Car Accident?
Not all accident cases necessitate the use of a lawyer. For example, if the accident in question only involved a small amount of property damage and no physical injuries, the accident victim might be better served handling the case on his or her own.

On the other hand, accident victims who have injuries that require ongoing medical treatment or physical therapy may want to consider working with a skilled car accident attorney in order to ensure that they receive just compensation for the injuries incurred and the long-term care that will be required.

Of course, deciding whether or not to hire a lawyer for a case is always up to the individual, but what you need to know is that accident victims who have lawyers by their sides tend to benefit greatly from their knowledge and skills.

Reasons Why Hiring An Attorney Might Be Helpful
Anyone who suffers injuries because of another person’s carelessness has certain rights under the law. Some accident victims might not be aware of their rights; therefore, hiring a lawyer might be beneficial to those who are not familiar with their legal rights.

Depending on the circumstances, there are additional reasons why working with a lawyer might be a good idea, including the following:

There are time limitations under the law for filing car accident lawsuits. If an accident victim does not bring the suit within the required time, the victim will lose his or her right to sue.
Insurance companies might not share an accident victim’s views regarding the accident. A lawyer can help with the negotiations and work to obtain fair compensation.
An accident victim might miss some of the potential damages to which he or she may be entitled. There may be many opportunities for compensation in a case, and a skilled attorney can make sure that all possible avenues are considered.

If you have been involved in a car accident and you want to make a determination regarding whether or not you need a lawyer for your accident case, contact one of our well-versed car accident attorneys immediately. Call us toll-free or email us today to schedule an appointment.

What To Do After A Car Accident

Car accidents can be extremely traumatic for some individuals. In fact, depending on the severity of the accident, some people experience long-term emotional issues afterward. Still, as the accident victim, you are required to do certain things under the law after the accident, and knowing what to do after a car accident is critical to ensuring that your legal rights are protected.

Given the state that many accident victims are in at the time of the incident, it should not be surprising that some victims do not have a clue about what needs to be done right away and what can be done at a later date. What you need to know is that it is imperative for you to speak with an attorney prior to making statements to an insurance company or signing any forms.

If you or a loved one has been involved in an accident, the experience might be very frightening and overwhelming for you. Allow one of our skilled car accident attorneys to help you handle the legalities of the case. Call us toll-free or email us for more information.

Safety First
One of the first things that an accident victim should do after a crash is to ensure his or her own personal safety, as well as the safety of any other passengers who may have been in the vehicle. Where possible, accident victims should move their vehicles over to the side of the road.

Get Medical Attention For Yourself And Others
An individual’s health and well-being are of utmost importance. If you, your passengers, or others at the accident scene have sustained injuries, the law requires you to provide reasonable assistance, if you are able to do so. That assistance could be something as simple as calling an ambulance or providing first aid if you have the know-how.

Stay Put And Call The Police
Under Texas law, after an accident occurs, all parties to the accident are required to stop and remain at the scene. Leaving the scene of an accident can lead to a separate set of issues that an accident victim will not want to deal with. Additionally, if you have the means to do so, call the police. The police will play an important role in any potential case you might bring because it is from them that you will receive a police report that will provide a description of what happened.

Gather Evidence
Accident victims should keep in mind that evidence will be crucial to proving their cases. It is very important for victims to keep a list of the names, addresses, and phone numbers of the parties of the accident, any witnesses to the accident, and the law enforcement officer who arrived at the scene and wrote the report. Also, if possible, accident victims should take photos of the scene, any damage to the vehicles and property, and any injuries incurred.

A Lawyer Can Tell You What To Do After A Car Accident
Some accident victims might become quite concerned with how much a car accident settlement is worth in light of the medical bills and ongoing treatment they might face. That is why it is crucial that victims know what to do after a car accident because following the proper steps can lead to a successful outcome to a case or claim.

If you have questions about the steps to take after an accident, call us toll-free or email us today to schedule a consultation.

Working With The Auto Insurance Company

Working with an auto insurance company can be a huge headache for accident victims. Insurers often use a variety of tactics on accident victims during so-called negotiations that may or may not be beneficial for the victim in the long run. What you should know as an accident victim is that whenever a claims adjuster shows some resistance with respect to a claim, you are not obligated to take a lower settlement offer as final.

Some individuals want to know if they need a lawyer for a car accident, especially if they do not intend to file a lawsuit. Even if an accident victim doesn’t intend to file a suit, having a lawyer by his or her side when attempting to work with the auto insurance company can prove to be quite valuable.

If you or a loved one has been involved in an accident and you believe that you need help working with the auto insurance company, contact one of our knowledgeable attorneys as soon as possible. Call us toll-free or email us today for more information.

Insurance Requirements Under Texas Law
Texas requires its drivers and vehicle owners to be financially responsible for their actions with respect to the vehicles they operate. All drivers and owners must have written proof of financial responsibility. Under state law, drivers can prove financial responsibility by having:

At least $30,000 of coverage for injuries per person, up to a total of $60,000 per accident, and $25,000 of coverage for property damage. This is called 30/60/25 coverage.
Individuals who don’t have the above-mentioned evidence can face legal penalties that will only make a bad car accident situation even worse.

Working With The Auto Insurance Company To Reach A Fair Agreement
Individuals who have suffered injuries and damages in automobile accidents want to obtain the most amount of compensation to which they feel entitled. However, claims adjusters are constantly looking to find ways to lower potential payouts and save the insurance company as much money as possible.

Two parties with competing interests can lead to some difficult negotiations. That said, accident victims who are concerned with ensuring that they obtain the best possible outcome should consider working with a local accident lawyer who has experience in dealing with insurance companies.

One thing that an accident victim should keep in mind is that insurers often attempt to rush victims to agree to settlements as quickly as possible. However, if an accident victim agrees too soon, he or she may miss out on compensation for additional medical and repair bills that the insurer or victim might not have considered initially.

If you or a family member has been in an accident and you’re thinking about handling insurance negotiations on your own, contact one of our lawyers first. Call us toll-free or email us to schedule an appointment today.

Bicycle Accidents

Similar to walking, bicycling is a cheap and easy method of public transportation. Much like pedestrians, bicyclists are in danger of being involved in a bicycle accident due to careless or negligent drivers.

The Insurance Institute for Highway Safety reports that a total of 843 bicyclists were killed in crashes with motor vehicles in 2019.

If you or a family member has been injured in a bicycling accident caused by another’s negligence, you need a strong advocate on your side to ensure you receive all of the compensation you are entitled to.

For all necessary assistance, come see our knowledgeable car accident attorneys. Call our law office or send us an email.

Bicycle Safety Trends
According to the NHTSA, a majority of bicycle accidents occur between the hours of 4 and 8 p.m. Bicycle accidents are also more likely to occur in urban areas, as opposed to rural areas. Around 72 percent of bicycle accidents occur in urban areas.

Either very young or slightly older individuals are also more likely to be involved in bicycle accidents, and the average age of those killed and injured in a bicycle accident continues to increase.

Bicyclists between the ages of 45 and 54 have the highest fatality rate based on population. However, individuals between the ages of 16 and 20 had the highest injury rate.

Males are also more likely to be involved in bicycle accidents. In fact, the majority of the bicyclists injured are male.

Safety Tips To Avoid A Bicycle Accident
There are many guidelines bicyclists should follow to avoid an accident with a motor vehicle. Some of these guidelines include:

Wear a bicycle helmet every time you ride.
Wear fluorescent or brightly colored clothing to increase your visibility to drivers.
Use a front light and red reflector or flashing rear light when bicycling at night.
Ride in the same direction as traffic.
Bicyclists are considered vehicle operators, just like drivers. This means that bicyclists must follow all of the applicable traffic rules such as obeying traffic signs and signals.

Drivers must also remember that they share the road with bicyclists. Drivers are required to exercise reasonable care and be especially alert for bicyclists when making turns. Drivers should also allow at least three feet of clearance when passing a bicyclist on the road and watch for bicyclists when pulling out of a driveway or opening a car door.

Consequences Of Bicycle Accidents
The dangers of bicycle accidents nationally are likely to remain.

If you or a loved one was injured in a bicycle accident caused by a negligent driver, it is a good idea to have your case reviewed by an experienced lawyer who can determine whether you are entitled to compensation.

If you have a solid case, you could be entitled to payment for medical bills and compensation for lost wages. Damages for pain and suffering are also frequently awarded in bicycle accidents.

Texting & Driving

Cellphones and text messaging have made communication convenient and efficient. However, distracted driving, and particularly texting and driving, has become a serious national epidemic and is one of the most common causes of motor vehicle accidents. Young people are especially known for texting and driving.

It is reported that 81% of Americans text regularly, over 6 billion texts are sent every day, and over 180 billion texts are sent every month. Sending or receiving a text message diverts a driver’s attention from the road for approximately 4.6 seconds. This may not sound like much, but it is the equivalent of driving the length of an entire football field at 55 miles per hour while blindfolded.

An individual who suffers injuries because someone else was texting and driving is entitled to compensation for his or her injuries.

Our car accident attorneys are here to help you with your claim against a distracted driver. Call us or send us an email to speak with an experienced lawyer.

Texting And Driving Is Abnormally Dangerous
The NHTSA defines distracted driving as any activity that takes a driver’s attention away from the main task of driving. Texting and driving is one of the most significant distractions and a leading cause of car accidents because it takes away nearly all of a driver’s cognitive abilities.

Reading and sending a text impairs visual perception and requires mental energy that should be completely focused on the road. Drivers who engage in these activities increase their risk of getting into an accident by three times.

In the short amount of time it takes to send or receive a text, a driver can cause a variety of accidents, such as a rear-end crash.

Teenagers And Text Messaging
Teenagers are generally inexperienced drivers. Unfortunately, they are also the most likely to participate in texting and driving. Teenagers represent the highest proportion of drivers who are distracted at any given moment.

A quarter of teenagers in a recent study reported that they reply to text messages at least once or more every time they drive.

The NHTSA also reports that in one year alone, 21 percent of the drivers involved in fatal car accidents involving drivers between the ages of 15 and 19 admitted to being distracted by the use of a cellphone.

Text Messaging Laws
Texting while driving is illegal everywhere in Texas, and some cities ban all cellphone use while driving. But using your cellphone while driving is always dangerous because it’s distracted driving. You cannot send or receive electronic messages while driving in Texas.

Texting and driving is a misdemeanor in Texas, which means a conviction creates a criminal record. Anyone who violates this law could receive a fine between $25 and $99, and repeat offenders could receive a fine up to $200. Injuries from an accident caused by text messaging frequently result in extremely large medical bills and lengthy rehabilitation for injured individuals.

Texting And Driving Is Negligent Behavior
A driver who causes an accident by engaging in texting and driving is likely to be considered negligent.

If a driver is shown to be negligent, compensation is available to cover the cost of medical expenses and lost wages. Injuries from a car accident also typically result in pain and suffering, and a negligent driver may be required to compensate a victim for these costs as well.

If you or a family member has been hurt or if you’ve lost a loved one because of a negligent driver, email us or call us to talk with one of our experienced car accident lawyers.

Rear End Collision

If someone is tailgating you, then that driver is doing something wrong, not you. According to the Texas Transportation Code Section 545.062, drivers should maintain a safe and clear distance from the cars in front of them considering speed, traffic, and driving conditions. Nearly half of the annual multi-vehicle accidents are rear-end collisions.

A rear-end collision is one of the most common car accident causes. If you are struck from behind by a negligent driver, you may not be held responsible for the accident, even if you were completely stopped.

If you were injured in a rear-end collision, contact our car accident lawyers by calling toll-free or by sending us an email to find out how we can help you.

Preventing A Rear-End Collision
All drivers are required to provide an acceptable amount of following distance between their vehicles and other vehicles on the road.

Drivers can avoid rear-end collisions by following a few simple rules:

Always maintain an adequate distance between your car and the car you are following.
Flash brake lights to give drivers following behind you warning of upcoming changes in traffic flow.
Use turn signals every time you turn.
Distracted driving is a serious national epidemic. Another way to prevent a rear-end collision is to avoid engaging in distracted driving, such as texting while driving or adjusting the radio.

What To Do After A Rear-End Collision
Even if you exercise reasonable care, you may still be involved in a rear-end collision with a negligent driver. When this occurs, you are likely to be confused and traumatized. However, you can take some important steps immediately following a rear-end collision.

First, check the injuries of everyone involved in the accident and call 911 for immediate assistance. Also, call the police as soon as possible and make sure a formal police report is filed. Having official documentation of the accident is vital for any future legal claims.

Take note of the surrounding conditions. Try to recall what the weather conditions were at the time of the accident and the time the accident occurred. Obtain the license plate number of the other driver in case he or she refuses to provide you with any personal information. Taking photos of the accident scene is also highly recommended.

Injuries From A Rear-End Collision
One of the most common injuries from a rear-end collision is whiplash, which can easily occur when a driver unexpectedly experiences a sudden blow from behind.

Drivers also typically suffer injuries to the face and head after a rear-end collision. Although certain safety features such as airbags and seat belts are designed to prevent injury, these features may not always work effectively during a rear-end collision.

If you’ve experienced any injuries as the result of a rear-end collision, you may have a viable claim for compensation. You may be entitled to a financial award covering your medical bills and lost wages, as well as the pain and suffering caused by your injuries.

If you are suffering from injuries suffered in a rear-end collision, our car accident attorneys are here to help you. Call us toll-free or email us to see how we can assist you.

Auto Defects

Although motor vehicles today are much safer than in previous years, auto defects remain one of the common causes of car accidents. When a vehicle malfunctions due to an auto defect, such as when an SUV rolls over, the vehicle has failed to provide you with reasonable safety and protect you in the event of a motor vehicle accident.

The law sets out minimum safety standards that manufacturers are required to follow when designing or manufacturing vehicles. Auto defects typically result in serious injuries to drivers, even if they were exercising reasonable care when driving.

If you’ve been injured due to a defect in the design of your vehicle, contact our car accident attorneys toll-free or send us an email and find out how we can assist you.

Common Auto Defects
There are a variety of common auto defects, such as:

Damaged brakes that wear out too fast or do not work at all
Faulty airbags that deploy too early, causing serious injury or death
Improperly designed seat belts which reduce their ability to prevent injuries or actually cause injuries
Poor tires that may blowout
Defective tires can also result in flats, which can lead to an accident.
In some cases, a defective gas tank could also start a fire that results in severe burn injuries. Although this list addresses some of the most common auto defects, it is important to remember that all parts of an automobile are susceptible to defects, and any part shown to be defective may give rise to legal liability.

Liability For Auto Defects
If you have experienced an auto defect that has led to serious injury, there are numerous parties that can potentially be held responsible. Automobile manufacturers can be held responsible for defects that occur in the design of an automobile, while dealers and repair shops may be liable for defects in the manufacture or maintenance of automobiles.

When an automobile manufacturer faces a design defect in one of its automobiles, it typically has two available options: recall the defective part or the entire line of vehicles, or face legal liability.

You Have The Right To A Safe Vehicle
An improperly designed automobile often means the difference between life and death. You cannot afford to take the significant risk that comes with driving an improperly designed or manufactured automobile.

The law requires that all vehicles be safely designed and manufactured to ensure maximum safety to drivers and prevent tragic injuries and wrongful deaths. Automobile defects can lead to a variety of dangerous car accidents, such as rear-end accidents.

If you’ve been injured in a car accident caused by an auto defect, you may be entitled to compensation for your injuries. Compensation may be available for your medical bills and any work you missed because of your injuries. You may also receive compensation for your pain and suffering.

Our car accident lawyers can help you pursue your case when you have suffered injuries due to an auto defect. Call us toll-free or email us to schedule an appointment.

Drunk Drivers

Drunk driving is illegal in all 50 states. Drunk drivers are a common cause of car accidents. Each year, drunk drivers are responsible for countless deaths and numerous injuries. A drunk driver behind the wheel of a car breaches the duty to drive with reasonable care and can be held responsible for his or her illegal and irresponsible behavior.

Drunk drivers not only face liability to any other drivers injured by their actions, but they also face additional legal penalties. Texas law is especially strict when it comes to drunk drivers.

If you’ve been injured by a drunk driver, contact our experienced car accident attorneys or send us an email to learn how we can help you get the compensation you deserve.

Drunk Drivers Are A Danger To The Roadways
Texas residents spend a significant amount of time driving on the state’s roadways However, drunk drivers on the roads pose a risk to everyone else, including pedestrians and bicyclists. Drunk driving is a foolish and extremely unsafe form of driving recklessly which puts everyone’s life at risk.

According to Mothers Against Drunk Driving, drunk drivers are involved in one out of every three accident fatalities. Additionally, an individual is killed every 53 minutes and injured every 90 seconds in drunk driving-related accidents.

Drunk drivers can be either first-time offenders or repeat offenders. MADD estimates that approximately one-third of drunk drivers are repeat offenders, while two-thirds are first-time offenders who have yet to face a drunk driving arrest.

Who Is Liable For A Drunk Driver’s Behavior?
If an individual is injured because of a drunk driver, third parties can be held responsible for the drunk driver’s actions. In addition to seeking compensation from the drunk driver, the individual who served the drunk driver may be held responsible for any resulting injuries.

For example, if a bartender serves an obviously intoxicated customer and the customer injures or kills another individual while driving a vehicle, the bartender can be held liable for the resulting damages. This concept extends to other individuals as well. Hosts of social events may also be held responsible for over-serving a social guest.

You Deserve Compensation From Drunk Drivers
Injuries from a drunk driving accident are often severe. An individual may experience not only substantial medical bills but also may be in a great deal of pain and unable to return to work. Feelings of aggravation and resentment at the unfairness of the situation are also common.

Losing a loved one because of a drunk driver may also leave an individual feeling angry and frustrated. Although no amount of money can ever make up for the tragic and unexpected death of a loved one due to a drunk driver, the legal system may be able to provide some compensation.

If you’ve been injured or lost a loved one due to a drunk driver, make an appointment with our car accident lawyers to get the compensation you are entitled to. Call us toll-free or email us.

Reckless Driving

Aggressive driving, also known as reckless driving, is another major cause of car accidents. You have probably encountered reckless drivers on the road many times. Their actions may cause you to modify your own driving behavior to avoid them, and this can lead to an accident. Reckless drivers place everyone around them in danger.

It is easy to spot reckless drivers. They are usually speeding or engaging in a range of other risky behaviors such as tailgating other drivers, running red lights or frequently changing lanes.

If you’ve been hurt by a reckless driver or a family member has been killed or injured as a result of a reckless driver, rely on our qualified car accident attorneys. Call us toll-free or email us to make an appointment.

Signs Of Reckless Driving
The DUI Foundation states that reckless driving occurs when an individual operates a vehicle in a dangerous or negligent manner. Some reckless driving is labeled reckless driving “de jure” or by law. This means that a driver who performs a certain behavior, such as driving a certain number of miles over the speed limit, is automatically labeled reckless.

Along with the dangerous behavior mentioned above, studies also show that playing music at a higher than normal volume so that other drivers can hear it is also a sign of reckless driving. Reckless drivers also tend to use their horns more frequently while they are maneuvering through traffic. Drunk driving is also an example of reckless driving.

Protect Yourself Against Reckless Driving
There are several things you can do to protect yourself against a reckless driver, such as:

Slowing down to let the reckless driver pass
Avoiding eye contact, which can sometimes aggravate the reckless driver further
Driving in the lane farthest away from the reckless driver
Ignoring any actions or gestures from the reckless driver
Most importantly, do not let your pride take over and attempt to challenge the aggressive driver. This behavior commonly leads to a crash. If the situation appears to be getting out of hand, it is best to simply pull over until the reckless driver is gone.

If you are concerned that the reckless driver may hurt or kill someone, call the police.

Avoiding Reckless Driving
It is important for all drivers to drive in a reasonable manner and exercise due care. All drivers are prone to engaging in reckless driving at times. It is possible to reduce the likelihood of reckless driving by avoiding certain behaviors, such as talking on a cellphone or attempting to multitask while driving.

It is also important to always drive according to the posted speed limit, regardless of whether you will be late to where you’re going. Being late to work or a scheduled appointment is never worth the risk.

The consequences of a reckless driving accident can wreak havoc on your life. When a reckless driver has caused your accident and left you badly hurt, you may be able to collect compensation for medical bills and lost wages, as well as pain and suffering.

One of the most important steps to take after your car accident is collecting all relevant information related to your car accident. A police report is a vital document. Document the names of the officers who responded to the accident.

Additionally, talk to individuals at the accident scene such as witnesses or passengers who may be able to provide additional information and fill in any gaps.

Hold onto all paperwork related to medical treatment. Keep a detailed log of all treatments and procedures as a result of the accident. Remember the names of every doctor you speak with, even doctors who simply refer you to someone else.

Keeping a journal is also highly recommended. Record any days you missed from work and document all of the ways your daily life has been disrupted because of the accident.

Determining Negligence
Negligence is the core legal theory on car accident lawsuits. The law presumes that every driver has a duty to drive with reasonable care. A driver who fails in this duty and causes harm or injury to someone else is negligent and can be held legally responsible.

For example, a driver has a legal duty to obey traffic signals. If a driver fails to stop at a red light, the driver has breached this duty. If the driver’s vehicle strikes your vehicle, causing you injuries and perhaps vehicle damage, there is a good chance a jury would determine that the other driver was negligent.

Since a negligent driver is legally required to compensate you for the injuries you suffered, you may have a valid case.

Make A Determination: Do I Have A Case?
You may feel as though your accident and injuries were caused by another driver’s negligence, but you still aren’t sure if you have a case. You want assurance from someone with the proper skills and knowledge before you file a lawsuit.

If you suspect that negligence caused your injuries, it is time to speak with a capable and compassionate personal injury attorney who can vigorously advocate on your behalf. There is minimal or no cost for an initial appointment, and the attorney will provide an honest assessment of your circumstances and your chance for success.

What To Do After A Car Accident

You may be in shock immediately after your car accident. These feelings are natural after a traumatic event and it may be difficult to remember what to do after a car accident; reviewing these basic steps will help you.

Knowing what to do in the moments immediately following a car accident is only a small portion of the necessary information you need to know about car accidents, but the information is nevertheless essential.

Call our experienced car accident lawyers toll-free or email us as soon as possible after your car accident for the help you need.

What To Do After A Car Accident
First, the most important rule to remember by far is to stay at the accident scene. Do not, under any circumstances, panic and drive away. Although you may fear the consequences of your car accident, the penalties for leaving the scene are far worse.

The only exception to this rule is if your accident occurs in a rural or deserted area and you fear for your safety. If this is the case, leave the accident scene and drive immediately to the nearest police station and report the accident.

Initial Steps
Check the injuries of everyone involved and provide any necessary medical treatment. After everyone appears relatively stable, call 911 and report the accident to the police.

Make sure a proper police report is filed. A police report can be a valuable piece of information if, later on, you are attempting to determine whether you have a legal claim due to the accident.

Gathering information is next. Exchange names, license numbers, and insurance information with all other drivers involved. Speak with any witnesses and ask them to describe what they saw. Get their names and phone numbers as well.

Do not say anything about who was at fault. Any admission, no matter how slight, could have serious legal repercussions. Remember that it is usually never clear who caused an accident in these initial moments.

Insurance Concerns
There are several important things you need to know in terms of how to deal with car insurance after an accident. Inform your insurance company as soon as is reasonably possible that you have been involved in a car accident.

The most important rule here is honesty. Do not lie to your insurance company about any fact regarding the accident, no matter how insignificant it seems. Aside from any potential legal liability this may entail, your insurance company can use your dishonesty against you by refusing to approve your claim.

What To Document
Take photographs of your vehicle, documenting the damage from the accident. This valuable photographic evidence will help you not only with your insurance company but also with any future legal claim.

Document everything related to any medical treatment you receive as well. Save copies of all medical reports and bills you receive. This documentation will prove invaluable if you need to prove how much your damages were.

Some Final Tips
Texas law states Steer It and Clear It: If there are no serious injuries and the vehicles can be driven, move them off the road to the nearest safe location.

Once things have calmed down, you may wonder if you have a legal claim. If a negligent driver caused your accident, you may be able to receive financial compensation for your injuries.

How To Deal With Car Insurance

If you’ve been in a car accident, you are probably going to have to work with a car insurance company if you want to gain some financial compensation. This means that you are going to have to know how to complete an insurance claim.

The car insurance claim process can be complex, and you would probably prefer to avoid the entire experience altogether. However, knowing how car insurance companies work is crucial after you’ve been in a car accident.

When you’ve been injured in a crash, one of our qualified car accident lawyers can be a valuable asset. Give us a call toll-free or email us to talk over your options.

Car Insurance In Texas
According to Texas law, in order to properly register a vehicle in Texas, you need to show that you are financially responsible. Although paying $40,000 in cash or through a certificate of deposit can do this, most people simply purchasing car insurance.

Texas requires the insured to purchase both bodily injury and property damage coverage. Minimum liability coverage in Texas is:

Texas law requires you to have at least:
$30,000 of coverage for injuries per person, up to a total of $60,000 per accident
$25,000 of coverage for property damage. This is called 30/60/25 coverage. Think about buying more liability coverage.
Bodily injury coverage pays for bodily injury that others suffer from a car accident in which you are involved; it does not cover injuries you suffer. Property damage coverage pays for damage you cause to someone else’s property or vehicle; it does not cover damage to your car. Collision coverage is available for that purpose.

Talking With Your Car Insurance Company
Contacting your car insurance company is an important step to take after you’ve been in an automobile accident. However, review your policy and make sure you understand your coverage limits before speaking with your car insurance company.

Do not make any verbal or written statements to your insurance company without a thorough understanding of your coverage. Additionally, do not let a car insurance representative fool you into thinking that your conversation may be recorded – it cannot be.

When your car insurance agent gives you an initial estimate of your losses, do not automatically agree to it. It is a common practice of car insurance companies to provide lower than average estimates. You are better off getting a second opinion before agreeing with an agent’s initial estimate.

How To Deal With Car Insurance Companies
Many car insurance companies set time limits for certain actions, such as filing a legal claim or providing a signed proof of loss. Be aware of these limits and ensure that you do not miss any crucial deadlines.

Do not accept or cash any check stating that it is a final payment unless you are ready to do so. Accepting or cashing this type of check could prevent you from pursuing any further legal claims against the car insurance company.

Finally, keep copies of all receipts for expenses you incur while dealing with your car insurance claim. These expenditures could potentially be included in your final settlement amount.

To ensure the best possible outcome, it is best to retain the services of a qualified attorney to help you deal with car insurance companies. Car insurance companies do not usually want to go to court and if they are convinced that you have a valid case, they are more apt to be flexible when determining a settlement amount.

Our car accident lawyers will help you achieve your goal of obtaining an adequate settlement from a car insurance company. Email us or call us toll-free today.

Personal Injury Claims Process

A careless driver is responsible for your injuries and you’re confident that you have a valid negligence claim. However, you’re unsure of what to do next; you don’t know exactly how the personal injury claims process works.

You might be unsure how much money you will have to spend, and if the cost will be worth the potential compensation. You may be confused over which steps to take and feel intimidated about going into court. The basic information below will ensure you are prepared for whatever comes next.

Email us or call us toll-free to meet with one of our knowledgeable car accident lawyers.

The Personal Injury Claims Process
Although the facts surrounding each personal injury claim vary, the personal injury claims process usually consists of the same basic steps:

Meeting with an attorney to determine if you have a case
Filing the initial court papers
Gathering evidence and establishing facts
Deciding whether to go to trial or settle the claim
If a judgment is rendered in your favor, you are entitled to collect the amount of money a jury has awarded, or that you have settled upon with the other side.

Filing Your Personal Injury Claim
After you meet with your attorney, he or she will file your complaint. The complaint consists of a basic outline of your case. The complaint names who the parties to the lawsuit are and lay out the facts of your case.

The complaint also states what legal theory you are pursuing, such as negligence, and the form of relief that you are demanding. This is typically an amount of money that you feel will properly compensate you for your losses.

Gathering Evidence
The next step in the personal injury claims process involves gathering evidence. This is called discovery. The three main forms of discovery are written discovery, document production, and depositions.

Written discovery usually consists of a form with specific pre-printed questions regarding your case. Answering these questions gives you a chance to tell your version of the events that led to the case.

Your attorney may also request that certain documents be produced. These can include medical records, receipts, and emails. Depositions occur when a party meets with an attorney and answers specific questions from the attorney under oath.

It is crucial to be honest with your attorney during the discovery process. Your attorney cannot advocate the best of his or her ability without knowing the full story.

Deciding Whether To Settle
A majority of cases do not go to trial. Parties typically reach a settlement before trial. If you decide to settle your case, you agree to forgo any further legal claims against the other party in exchange for a certain sum of money.

If you think you might want to settle rather than go to trial, it is absolutely essential to discuss any settlement offers thoroughly with your attorney before accepting any offer.

Collecting Your Judgment
The final step in the personal injury claim process is to collect the money you are owed. If the opposing party is insolvent or refuses to pay you, your attorney can help you take certain steps to collect the money, such as garnishing wages or a bank account.

The personal injury claims process can be complicated. An experienced legal advocate can assist you every step of the way.

What Is A Car Accident Case Worth?

Before deciding to file a lawsuit, you may ask, “What is a car accident case worth?” You may wonder if it is worth going to court over.

Many of your medical bills are for substantial amounts, and you’re watching them pile up every day. You’re also losing money every day that you miss work because of your injuries. You need to learn as much as you can about the personal injury claims process in order to determine whether filing a lawsuit is worth it.

Our car accident lawyers can provide expert assistance when you’ve been hurt in a car accident. Give us a call toll-free or email us to make an appointment.

Medical Expenses
A negligent driver who causes you harm should pay for your medical expenses. Medical expenses that you are entitled to compensation for include:

Emergency room treatment
Ambulance bills
Doctor bills
You should also be compensated for all future medical treatment that is necessary because of your car accident. Once you have a rough estimate of how much your medical expenses have cost you, this figure is used as a guideline in determining your overall compensation.

Lost Wages
You are also entitled to recover all of your lost wages due to being unable to work because of your injuries. Lost wages are usually measured from the time of the car accident up until the date of settlement. You should be able to recover everything you would have earned during this time.

You could be entitled to recover lost wages even if you were unemployed at the time of the accident. If you can show that you were willing and able to work during your accident recovery period, you may receive an amount equal to what you could have earned.

What Is A Car Accident Case Worth? Additional Compensation
You may also be entitled to damages for your pain and suffering. A damage award is usually based on these three things:

The nature and severity of your injury
The likelihood that you would experience future pain
The length of time your pain is expected to last
A car accident often results in more than just physical injuries. There is a high likelihood that you are also suffering detrimental mental effects.

You may have frequent nightmares, be afraid of getting behind the wheel of your car, or experience feelings of anxiety, shock, or embarrassment over your accident. A qualified attorney can help you receive compensation for any mental anguish you suffer as well.

If you have lost a family member or a loved one in a car accident and file a wrongful death claim, you are entitled to any contributions you would have received from your deceased loved one. This includes not only lost earnings from your deceased loved one, but potentially a damage award for loss of companionship as well.

It is highly beneficial to hire an experienced car accident attorney to help you collect the maximum amount of compensation you are entitled to.

Despite the fact that automobile technologies have advanced in recent years, thousands of motor vehicle accidents still occur on a yearly basis. According to the statistics provided by the Texas Department of Transportation, Texas experienced an increase in the
number of motor vehicle traffic fatalities. The 2020 death toll of 3,896 was an increase of 7.54% from the 3,623 deaths
recorded in 2019. There were 12,107 serious injury crashes in Texas in 2020 with 14,656 people sustaining a serious injury. These numbers are quite unfortunate, especially for the victims and their families.

Not all drivers are concerned about the safety of others with whom they share the road. That said, many accidents that take place can be avoided if certain drivers would use a little more caution and care while driving. It is important for individuals who have suffered injuries from motor vehicle accidents due to someone else’s negligence to know their rights.

If you or a loved one has been hurt in a motor vehicle accident, contact one of our skilled car attorneys as soon as possible. Call us at toll-free or email us today to discuss the case.

Types Of Motor Vehicle Accidents
Automobile accidents can take place at any time, and the types of accidents that occur vary. Some of the motor vehicle accidents that may lead to injuries or even death include:

Car accidents: Motor vehicle accidents that involve cars are extremely commonplace. Minor injuries, as well as severe, life-changing injuries can result from a car accident. Injured individuals may be entitled to compensation based on the facts of their cases.
Motorcycle accidents: Motorcycles are a preferable mode of transportation for many people; however, riding motorcycles on busy streets can be a bit risky. The reasons for motorcycle accidents can vary, and when a motorcyclist is involved in an accident, the results can be devastating.
Truck accidents: Truck accidents are quite prevalent, and unfortunately, many of those accidents end in death. Individuals who survive truck accidents, however, often face serious injuries, high medical bills, and long-term rehabilitation costs. Truckers are required to follow certain federal and state laws and when they fail to do so, they must be held responsible.
Pedestrian accidents: Thousands of pedestrians are injured or killed every year. Pedestrian accidents can take place anywhere, but they tend to happen more frequently at intersections and crosswalks. Whenever a driver causes a pedestrian’s injury or death, the driver could be held responsible, depending on the facts of the case.
Bicycle accidents: Under the law, bicyclists who take to the streets have the same rights as motor vehicles who travel those same streets. However, some motor vehicle drivers fail to share the roadways with bikes as required. Despite efforts to advocate for bicycle safety, there continues to be a large number of bicycle accidents.
When accidents occur, those involved may have questions about what to do or who to contact. Accident victims do not have to attempt to handle their own cases – help is available.

A Lawyer Can Help Motor Vehicle Accident Victims
Negligence is often a primary cause of motor vehicle accidents, but proving negligence can be difficult. People who are injured in an accident are advised to work with skilled car accident lawyers who can thoroughly investigate the accident, make a determination on the best course of action and fight hard to protect their rights.

If you or a loved one has been injured in a motor vehicle accident, contact one of our attorneys today. Call us toll-free or email us to schedule a consultation.

Car Accidents
In Texas, many people depend on their motor vehicles for transportation every day. With so many vehicles on the road, the odds of a car accident occurring are very high. Several factors can cause car accidents. These reasons may include careless motorist behaviors such as reckless driving, speeding, and even drunk driving. When a collision occurs, the results can be life-altering.

Car accidents can be stressful for those involved. Depending on the severity of the accident, those involved may face long-term injuries that will require extensive medical treatment. In some cases, the costs associated with motor vehicle accident injuries can be astronomical. That is why it is important for accident victims to work with a skilled car accident attorney as soon as possible after the accident.

If you or a loved one has been hurt in a car accident, contact one of our capable accident lawyers right away because time is of the essence. Call us toll-free or email us today to discuss the facts of the case.

Determining Who’s At Fault In Car Accidents
Some car accidents clearly indicate fault, such as in the case of many rear-end collisions. However, proving fault in other types of vehicle accidents, like truck accidents, may be a little more challenging. That said, accident victims are encouraged to work with knowledgeable car accident attorneys who are familiar with the laws regarding vehicle accidents.

Working with an attorney is important because, in order to prove fault, a proper investigation will need to be done in a timely fashion. If too much time passes, evidence might be lost, and if there were any witnesses to the accident, those witnesses might become unreachable. An attorney can work to preserve the rights of accident victims and ensure that all appropriate parties are held responsible for their wrongdoing.

The Statute Of Limitations For Bringing A Lawsuit
With respect to car accidents, those who are interested in filing a lawsuit against a responsible party will be subject to the time limitations that are placed on such cases under Texas law. These laws are commonly referred to as the statute of limitations, and all states in the U.S. have such statutes.

Texas time limitations regarding car accident lawsuits are as follows:

For a personal injury lawsuit, an individual will have two years from the time of the accident to file.
For a lawsuit that is related to property damage (such as damage to the motor vehicle), an individual will also have two years to file.

If you have been injured in a car accident or if you have lost a loved one in a motor vehicle accident, you do not have to deal with your case on your own – allow us to help you. Contact one of our well-versed car accident attorneys today by email or by calling us toll-free.

The Causes Of Truck Accidents

Determining the cause of truck accidents is very important, especially for accident victims, because once a determination has been made in that regard, a knowledgeable lawyer can ensure that all appropriate parties are held responsible for their actions. There are various reasons why truck accidents happen. Truck accidents can occur because:

The truck was improperly loaded or overloaded with cargo
The tractor-trailer’s brakes failed
The tires on the truck blew out
The driver was reckless or negligent
Additionally, some truck drivers operate their trucks while they are tired, and some drive while they are under the influence of drugs or alcohol. Whatever the reason is for the truck accident, the lives of those involved can be changed forever after its occurrence.

That said, those who are involved in car accidents with trucks should speak to an accident lawyer as soon as possible to preserve their rights. Trucking companies tend to start their investigations almost immediately, and you should have an advocate working on your behalf at the same time.

Things To Consider In Truck Accident Cases
Truck accidents are a bit different from car-on-car accidents, mainly because federal rules and regulations govern trucks, in addition to state laws. For instance, the guidelines set forth by the Federal Motor Carrier Safety Administration require truck drivers to follow certain rules with respect to the number of hours they drive and the number of hours they rest. Furthermore, the FMCSA also has licensing standards, and when trucking companies and drivers disregard those standards, accidents can happen.

A well-versed accident lawyer can assist truck accident victims in a number of ways. The attorney can evaluate the case and determine whether or not a viable case exists. If a case exists, the attorney can estimate the value of the case by looking at things such as the severity of the injuries, the victim’s portion of liability, and insurance coverage.

Individuals who have been injured or have lost loved ones in truck accidents should contact one of our capable attorneys as soon as possible. Call us toll-free or email us immediately to schedule an appointment.

Pedestrian Accidents

Pedestrians who are walking along streets are especially vulnerable to accidents that can lead to serious injuries or even death. According to the National Highway Traffic Safety Administration, thousands of pedestrians either are killed or suffer injuries in motor vehicle-related pedestrian accidents throughout the United States every year.

Depending on the nature of the accident, pedestrian accidents can result in life-altering injuries that can lead to accident victims being out of work for months or even permanently. That being the case, some accident victims might experience not only emotional devastation but also financial devastation. However, there is help for pedestrian accident victims and their families.

If you or a loved one has been involved in a pedestrian accident, contact one of our accident attorneys to discuss your legal remedies. Call us toll-free or email us immediately for a case evaluation.

Pedestrian Accidents That Involve Injuries
Whenever a pedestrian is hit in a motor vehicle accident, the probability of the pedestrian sustaining injuries is very high. The reason is obvious: when a passenger vehicle that weighs around 2,000 pounds crashes into an individual who might weigh 200 pounds, the result is likely to be either injury or death, depending on the severity of the accident.

There are a wide variety of injuries that can result from pedestrian accidents. Some of those injuries include:

Internal organ damage
Broken bones
Major head trauma
Spinal cord injuries
Pedestrians involved in car accidents might experience the above-mentioned injuries even at low speeds. That said, pedestrian accident victims should not hesitate to contact a knowledgeable accident lawyer as soon as possible to learn more about their rights and legal options.

Obtaining Compensation For Pedestrian Accident Injuries
Many pedestrian accident victims, or the family members of those killed in pedestrian accidents, often want to know more about the possible financial compensation to which they may be entitled. A capable attorney can assist victims with determining the amount of financial compensation that might be recovered from those who are responsible for the accident.

Under Texas law, pedestrians can receive compensation for the same types of damages as those who have been involved in bicycle accidents or vehicle accidents. Those damages can include monetary compensation for medical bills, lost wages, emotional distress, and other accident-related expenses. In some cases, punitive damages might be awarded in addition to actual damages.

What Should Pedestrian Accident Victims Do After An Accident?
The first thing that a pedestrian accident victim should do is seek medical attention right away. Victims should also make sure that they comply with all of the health professional’s directions and take all medications as prescribed. Medical evidence will be key in a pedestrian accident case, so hiring an attorney to help gather such evidence and obtain expert testimony where needed might prove to be quite beneficial.

If you have been hurt in a pedestrian accident, contact one of our skilled accident lawyers today. Call us toll-free or email us immediately to schedule a consultation.

Bicycle Accidents

Bike ridership has increased in recent years. As the ridership increased, the occurrence of bike accidents became more evident to lawmakers throughout the state. Despite the state’s best efforts to protect bike riders, hundreds of bicycle accidents are reported to the Police Department on a yearly basis; however, many bike crashes go unreported.

Bicycle accident cases can be more complex than motor vehicle accident cases, mainly because there’s often a question concerning who had the right of way. That is why it is crucial for a bicycle accident victim to consider hiring a competent accident lawyer to handle his or her case because a lawyer can ensure that the victim receives all of the compensation to which he or she is entitled.

If you or a loved one has been injured in a bicycle accident, contact one of our accident attorneys right away. Call us toll-free or email us to review the facts of your case.

The Leading Causes Of Bicycle Accidents
Three of the leading causes of bicycle accidents are:

Speeding
Turning
Dooring
Other causes of bicycle accidents include roadways that had gravel or sand on them, railroad tracks, collapsed bike rims, and bicycle chains that broke after catching on something.

Bicycle Accidents That Involve Commercial Trucks
Truck drivers are subject to both federal and state laws. When drivers and the companies for whom they drive fail to abide by those laws, injured individuals can hold them responsible for accidents that occur because of their actions or inactions.

Some of the issues that might arise in truck accident cases that involve bicyclists include broken or inadequate truck equipment issues, turning radius issues related to the tractor-trailer, and truck blind spots. Cyclists who have been hurt in a bicycle accident that involved a commercial truck should seek advice from an area lawyer who has experience with handling such cases.

The Types Of Compensation That Might Be Recoverable In A Bicycle Accident Claim
Bike riders who are injured by motor vehicles may be entitled to recover for a number of damages based on the facts of the case. For instance, cyclists might be able to receive financial compensation for past and future medical bills, lost wages and future earning potential, emotional distress, and property damage. A skilled accident lawyer can further advise bicycle accident victims on possible recovery.

If you or a loved one has been injured in a bicycle accident, allow one of our local attorneys to assist you with your legal needs. Call us at toll-free or email us today to schedule an appointment.

Car Accident Causes

Thousands of people use their automobiles to travel to and from their chosen destinations on a daily basis. No one ever plans to be involved in a motor vehicle accident, but given the number of cars on the road, accidents are bound to happen. Car accident causes will vary; however, speed is the main factor in approximately 28 percent of injury collisions and fatalities that occur within the state.

No matter what actually causes a car accident, the results of that accident can be traumatic for the victims and their families. Accordingly, car accident victims are encouraged to work with knowledgeable attorneys who can thoroughly investigate their accidents, look into possible causes and determine who to hold responsible for the injuries incurred.

If you or a family member has questions about what actions or inactions can cause a car accident, contact one of our skilled car accident attorneys right away. Call us toll-free or email us today to discuss your case.

What Are Some Common Car Accident Causes?
Accidents can happen at any time, for any reason. There are, however, several common causes for car accidents. Some common car accident causes are:

Drunk driving accidents: When individuals who are under the influence of drugs or alcohol choose to drive, the results can be tragic. The presence of too much alcohol or too many drugs in a person’s system can lead to slower response times and overall impaired driving.
Texting while driving: One of the most dangerous forms of distracted driving is texting while driving. Despite the fact that it is illegal in Texas, many drivers continue to type, send and read texts while operating motor vehicles. When drivers text while driving, they take their eyes off the road, which can ultimately cause car accidents.
Reckless driving and speeding: A reckless driver is one who disregards the safety of other people and their property while operating a motor vehicle on the street or in a parking lot. Speeding is a form of reckless driving that not only violates state law but can also lead to devastating accidents.
Defective car parts: There are also car accident causes that don’t necessarily involve another driver on the road. Defective car parts cause some car accidents. Faulty cars and car parts can lead to extensive injuries or even death.
Dangerous roads: Poorly designed and poorly maintained roads can cause motor vehicles to veer off the road, roll over, or crash into fixed objects. Dangerous roads are a major cause of car accidents.
Another common cause of car accidents is driver fatigue. In order for a driver to navigate the busy streets, he or she must be alert. However, some drivers risk their lives and the lives of others by operating motor vehicles when they are too sleepy or tired to do so safely.

A Lawyer Can Help
Any number of things can cause car accidents. That said, it is very important for car accident victims to work with well-trained lawyers who are familiar with common car accident causes.

Drunk Driving Accidents

Drunk driving, much like reckless driving and speeding, is a serious problem that affects the lives of thousands of individuals and their families every year. In fact, according to the National Highway Traffic Safety Administration, there were 10,142 fatal drunk driving accidents in the U.S. in 2019. It is clear that drunk driving causes car accidents and the statistics are very disheartening.

Many drunk drivers who cause accidents are punished by the criminal court system; however, the criminal system does nothing to compensate accident victims or their families for their losses. A skilled car accident attorney can help victims and their families receive the just compensation they deserve through the civil court system.

If you have been hurt or a loved one has died in a motor vehicle accident caused by a drunk driver, you have rights. Contact one of our capable lawyers today to discuss the details of your case. Call us toll-free or email us right away.

Drunk Driving Accidents And Liability
Individuals who are hurt in drunk driving accidents, as well as those who lose family members because of drunk drivers, might be entitled to financial compensation. However, there are a few things that will need to be proven in a civil lawsuit against a drunk driver. A drunk driving accident victim or the family member of a deceased victim must prove that:

The driver was intoxicated
The level of the driver’s intoxication was too high to safely operate a vehicle
The driver failed to use reasonable care
Establishing civil liability against a drunk driver might be difficult for accident victims and their families to handle on their own. That is why victims are encouraged to seek legal guidance from skilled attorneys who are familiar with the laws and the intricacies of the civil court system. An attorney can help a victim obtain fair compensation for his or her loss.

Obtaining Compensation In Drunk Driving Accident Cases
Accident victims whose lives are changed by drunk drivers can seek monetary compensation for their injuries. Additionally, in cases involving the death of a loved one due to a drunk driver, the family members may be entitled to pursue a wrongful death claim against the driver.

Drunk driving accident victims may be entitled to compensation that will cover medical bills, lost wages, property damage, and pain and suffering. Moreover, a skilled attorney might also pursue what is known as punitive damages. Punitive damages in drunk driving cases are generally designed to financially punish the driver who caused the accident for his or her actions and hopefully deter others from doing the same thing in the future.

Drunk driving accidents can be both physically and financially devastating for the victims and their families, but help is available.

If you have been injured in a motor vehicle crash that was caused by a drunk driver, or if you have lost a loved one in a drunk driving accident, let one of our competent car accident attorneys help you obtain justice. Call us toll-free or email us today to schedule a consultation.

Back & Spine Injuries

The back and spine are some of the most vulnerable areas of the human body and are therefore especially susceptible to injury in a car accident. Even a minor twist or strain to back muscles can cause a back and spine injury and result in chronic pain.

Back injuries can be expensive and difficult to treat. A spinal injury is often a plaguing injury that can result in paralysis.

Back injuries are an especially serious type of car accident injury because they can sometimes make it impossible for an individual to return to work. Although individuals who suffer a back injury may recover enough to be able to train for a new career, those who experience a spinal cord injury that causes paralysis may never be able to work again.

Back Injuries Can Cause Extreme Pain
Back and spine injuries are a common repercussion of another injury, such as a neck injury. Back pain is a frequent complaint of individuals who have been in a car accident. According to the Mayo Clinic, back pain is one of the main reasons individuals visit the doctor and are forced to miss work.

The back is made up of vertebrae in the spine, cushioned by disks in between the individual vertebrae. During a car accident, the soft material inside a disk may shift out of place or even rupture and cause strain to nerves around the spine, resulting in excruciating back pain.

An individual who experiences back pain after a car accident may feel sudden spasms or a shooting pain that travels from the back to the legs. Muscle aches are also common, and an individual may also have trouble standing up straight or lose his or her normal range of motion.

Spinal Cord Injuries
Spinal cord injuries are the result of damage to the ligaments, discs, or vertebrae of the spinal column. A spinal cord injury can also occur when the nerves at the end of the spinal cord sustain damage. Even the slightest impact could result in a back and or spine injury.

The Mayo Clinic states that spinal cord injuries can have permanent repercussions. An individual who experiences a spinal cord injury faces a host of bodily issues, such as a decrease in strength, less sensation in certain areas of the body, and trouble performing bodily functions below the area of impact.

Treatment Is Available
Back and spine injuries can often be treated through a variety of methods. Some back pain can be treated with over-the-counter medication. Although bed rest is recommended, it should not be done for more than two days, or the back pain could worsen rather than improve.

A doctor will normally prescribe common pain relievers for back pain. If the pain does not improve, muscle relaxers may be prescribed. Narcotics or antidepressants may also be prescribed for extreme back pain.

Although medications may be prescribed for a spinal cord injury, immobilization of the back is often undertaken to stabilize the spine.

Back and spine injuries sustained in an automobile accident take an extreme physical and emotional toll on an individual. Fortunately, financial compensation may be available from a negligent driver.

Neck Injuries

You usually notice when a car is following too closely behind you. It probably makes you nervous. If traffic ahead of you suddenly stops or a child unexpectedly darts out into the road, a negligent driver behind you will likely crash directly into your vehicle and suddenly you’re the victim of a neck injury. Neck injuries are one of the most common types of car accident injuries, usually resulting from a rear-end crash.

Although most car accident injuries require expensive treatments, neck injuries from a car accident that results in whiplash can be especially costly and take a long time to heal.

Come talk to one of our car accident lawyers if you’ve been injured in a crash. Call us to schedule a consultation.

Common Neck Injuries
The neck is composed of bones, joints, tissues and nerves that all work together to support the head. Although the soft tissue of the neck may be the only area that sustains damage, the damage may affect a variety of muscles throughout the body, as well as the spinal cord.

When there is a break in the cervical cord, a neck fracture results. The type and extent of the break depend on the position of the head upon impact and the angle at which the impact occurs.

A neck sprain may occur when the neck twists as the result of the sudden impact of a car accident. A neck sprain is usually the result of ligament damage. Ligaments are blocks of tissue that hold bones together.

Neck Injuries Affecting The Spine
Neck injuries are also related to spinal cord injuries. Spinal cord injuries can be caused from whiplash which damages joints or disks, which result in spinal cord irritation. A spinal cord injury can result in permanent disability, paralysis and can even be fatal.

Neck Injuries And Whiplash
Whiplash can best be envisioned by someone cracking a whip. When a car is unexpectedly smashed from behind, such as in a rear-end collision, the impact can cause the neck to suddenly snap forward and backward. These unnatural movements stretch the neck muscles and ligaments well beyond their normal range of motion.

Although whiplash may heal on its own after a few months, many times whiplash results in chronic pain that can last for years, which can require expensive treatment or rehabilitation.

Whiplash can also continue to persist for many years after an accident without any known cause.

Treatment Options
There are a variety of treatments for neck injuries. Treatment for a neck fracture depends on an individual’s age, current health and whether there is any spinal damage. A neck brace may be required to stabilize the neck.

Neck sprains can be treated by placing ice on the affected area and getting plenty of rest. Anti-inflammatory medication may also be prescribed.

The type of treatment given immediately after a spinal cord injury often depends on the long-term effects.

Whiplash is normally treated with over-the-counter medications and applying ice to the affected neck muscles. Prescription medications and physical therapy are other options.

Treatment for any sort of neck injury is often expensive. If a neck injury from a car accident was caused by a driver’s negligence, financial compensation may be available to the victim.

Brain Injuries

Today many vehicles are equipped with safety features that are designed to minimize the negative impact of a car crash. However, head and brain injuries are still frequently cited as common types of car accident injuries and may cause long-term damage.

Brain injuries result from a sharp blow to the head or an object piercing the skull. If the head comes in contact with a hard object during a car accident, such as a windshield, this can result in a brain injury.

All car accident injuries are serious, but head and brain injuries are especially troublesome because the healing process is extremely slow. There is also a risk of permanent brain damage.

Our experienced car accident lawyers are here for you if you’ve suffered an injury in a crash. Call us to make an appointment.

What Is A Brain Injury?
The life of an individual who suffers a brain injury due to a negligent driver is forever altered.

It is essential for a brain injury victim to have access to expert medical care, as brain injuries require expensive and long-term rehabilitation. It is also crucial for brain injury victims to receive personalized medical attention and have access to specialized services tailored to their unique brain injury in order to continue to live a healthy and productive life.

A concussion is a form of brain injury that is now typically referred to as traumatic brain injury, or TBI. The Centers for Disease Control and Prevention has called TBI a serious public health problem in the United States. It is estimated that approximately 1.7 million TBI’s occur every year either as isolated incidents or in conjunction with other types of injuries, such as head injuries or neck injuries.

Traumatic Brain Injury Symptoms
A TBI is alarming because symptoms may occur immediately or may not become apparent until long after an accident. Brain injuries are classified as mild, moderate or severe. Common symptoms of a mild TBI include:

Headache
Dizziness
Problems with memory or concentration
Ringing in the ears or blurred vision
Feelings of disorientation

A TBI victim may also experience loss of consciousness every so often. More severe symptoms involve changes in a victim’s mood or personality. Depression and anxiety are common with moderate or severe TBIs.

Treatment Of Brain Injuries
Mild TBIs typically only require rest and over the counter medications to heal. Immediate emergency treatment should be provided for moderate to severe brain injuries with the goal of maintaining an adequate level of blood and oxygen and attempting to minimize further injury.

Medications such as diuretics, coma-inducing drugs and anti-seizure drugs may also be prescribed for moderate to severe TBIs.

Long-term rehabilitation is also usually required for a severe TBI as a victim may need to relearn how to walk, talk or perform basic bodily movements. Physical and psychological therapy is also essential. It is for this reason that treatment of TBIs can become astonishingly expensive.

The repercussions of brain injuries can last a lifetime. An individual may be unable to return to a former job or be prevented from returning to work altogether. However, compensation from a negligent driver who caused a brain injury may be available.

A devoted legal advocate is absolutely essential if you have suffered a brain injury. Call us to learn more about how we can help you.

Car Accidents

Car accidents are the most common type of motor vehicle accidents, occurring more frequently than both truck and motorcycle collisions.

According to the National Highway Traffic Safety Administration, over 33,244 people were killed in motor vehicle crashes in 2019, while over 2 million were injured. Passenger vehicles made up a large portion of these accidents.

After a car crash, email us or call our experienced car accident attorneys for valuable knowledge and capable assistance.

Important Safety Measures
One of the primary responsibilities of the NHTSA is to oversee the safety standards of automobile manufacturers. This is done by implementing Federal Motor Vehicle Safety Standards. One of these standards is the use of seat belts. According to the National Highway Traffic Safety Administration (NHTSA), more than 15,000 lives are saved each year in the United States because drivers and their passengers were wearing seat belts when they were in a road traffic crash.

Another FMVSS standard involves the use of airbags. The NHTSA currently recommends that children age 12 and under sit in the rear seat away from the force of a deploying frontal airbag.

Protecting Yourself And Your Passengers
It is important for drivers and their passengers to protect themselves by always wearing seat belts. The Centers for Disease Control and Prevention states that wearing a seat belt is the most effective way to prevent death and serious injury in the event of an accident.

Current Texas law requires everyone in a vehicle to buckle up or face fines and court costs up to $200. Children younger than 8 years must be in a child safety seat or booster seat unless they’re taller than 4 feet 9 inches. If they aren’t properly restrained, the driver faces fines up to $250, plus court costs.

Determining Negligence After A Car Accident
To determine if a driver was negligent and should be required to pay damages resulting from a car accident, the following factors must be considered:

Everyone has a legal obligation to drive with reasonable care under the circumstances. This is known as a duty of care.
This duty of care can be breached. For example, a driver who drives too fast or too aggressively has breached the duty of care.
Failing to use reasonable care can cause a car accident. For instance, a speeding driver could lose control of a vehicle and collide with another driver’s vehicle.
The driver’s recklessness caused harm to someone.
If each of these factors is shown, a driver is negligent and therefore can be held legally responsible for the cost of damages caused by the negligent behavior.

Negligence Law
Texas follows the “modified comparative negligence” doctrine where damages are barred or reduced according to your degree of fault.

For example, if a driver runs a red light and collides with another driver who is speeding, both drivers may be found negligent. A jury could find that the speeding driver was 25 percent negligent and the driver who ran the red light was 75 percent negligent.

This means that the driver who was speeding could recover damages amounting to 75 percent of the cost of injuries since this is the percentage of negligence that was not the speeding driver’s fault. The driver who ran the red light could receive damages amounting to 25 percent of the cost of injuries.

Pedestrian Accidents

The beautiful Texas climate makes walking an enjoyable activity for many residents. Residents may walk for exercise or use it as an inexpensive and convenient form of transportation. However, pedestrian accidents are common and pedestrians must make sure to follow all traffic laws. Even when a pedestrian is cautious, he or she could be injured in an accident involving a motor vehicle.

If you have been injured in a pedestrian accident, contact our experienced car accident lawyers. Email us or call us toll-free.

Pedestrian Accident Statistics
The Insurance Institute for Highway Safety reports that 6,205 pedestrians were killed in 2019.

A pedestrian accident is more likely to occur in an urban area rather than a rural area. A majority of pedestrian accidents happen at night, with 30 percent of pedestrian accidents have occurred between the hours of 8 p.m. and midnight.

Children and older individuals are especially likely to be involved in pedestrian accidents. The fatality rate for pedestrians age 65 and older was higher than the rate for all other age groups. Nearly one-fifth of children between ages five and nine killed in motor vehicle accidents were pedestrians.

Pedestrian Laws
Texas pedestrians are subject to many of the same laws as drivers. For example, pedestrians are required to follow traffic control signals at intersections or crosswalks in the same manner as drivers.

However, drivers are required to exercise due care to avoid striking pedestrians and use a horn when necessary to alert a pedestrian to their presence. Drivers are also expected to exercise extreme caution when encountering a young child pedestrian or a pedestrian who appears confused or incapacitated.

Although a driver must yield the right of way to a pedestrian lawfully crossing in a crosswalk, a pedestrian cannot suddenly leave a curb and walk directly into the path of an oncoming motor vehicle, making it impossible for the driver to yield in time.

A pedestrian crossing anywhere outside of a marked crosswalk or in an unmarked crosswalk must also yield the right of way to drivers.

Pedestrian Safety
The NHTSA provides several common-sense tips for pedestrians to avoid an accident, such as:

Walk on a sidewalk.
If there is no sidewalk, walk on the shoulder of the road against oncoming traffic.
Walk in a designated crosswalk when crossing a street.
Stop and look left, right, and left again before crossing a street.
Carry a flashlight and wear reflective clothing at night.
Pedestrians should also make sure to not walk while they are intoxicated. It is estimated that in about one-third of all fatal pedestrian accidents, the pedestrian had a blood-alcohol level at or above .08 percent, which is the legal limit in many states.

The Duty Of Reasonable Care
Pedestrian accidents can involve negligence on the part of the driver or the pedestrian, similar to automobile accidents. Both drivers and pedestrians are required to exercise reasonable care on the roadways, and both could be found negligent and liable for damages if their failure to use reasonable care causes harm to another.

Seek out a car accident attorney if you are involved in a pedestrian accident. Email us or call us toll-free for an appointment.

Pedestrian fatalities decreased 3 percent from 2018 but still account for 17 percent of all crash fatalities. Although pedestrian deaths were 17 percent lower in 2019 than in 1975, they have increased 51 percent since reaching their lowest point in 2009.

A pedestrian accident is more likely to occur in an urban area rather than a rural area. Bicycle Accidents

Similar to walking, bicycling is a cheap and easy method of public transportation. Much like pedestrians, bicyclists are in danger of being involved in a bicycle accident due to careless or negligent drivers.

The National Highway Traffic Safety Administration reports that 846 bicyclists were killed and many thousands were injured in 2019.

If you or a family member has been injured in a bicycling accident caused by another’s negligence, you need a strong advocate on your side to ensure you receive all of the compensation you are entitled to.

For all necessary assistance, come see our knowledgeable car accident attorneys. Call our law office toll-free or send us an email.

Bicycle Safety Trends
According to the NHTSA, a majority of bicycle accidents occur between the hours of 4 and 8 p.m. Bicycle accidents are also more likely to occur in urban areas, as opposed to rural areas. Around 72 percent of bicycle accidents occurred in urban areas.

Either very young or slightly older individuals are also more likely to be involved in bicycle accidents, and the average age of those killed and injured in a bicycle accident continues to increase.

Bicyclists between the ages of 45 and 54 had the highest fatality rate based on the population.

According to the Texas Department of Transportation, Texas bicyclist fatalities totaled 79 in 2020. This is a 16.18% increase from 2019.

INJURED IN AN ACCIDENT ON SOMEONE ELSE’S PROPERTY? WE CAN HELP.

Premises liability is a term used to refer to a certain area of personal injury law that involves accidents and injuries that occur on another person’s property. In certain situations, the property owner or manager may be held liable for injuries that occur on their property, if these injuries occurred as a result of their negligence. For example, a property owner may fail to conduct routine inspections and may therefore leave a hazardous condition (such as a missing stair) unfixed, causing a customer or patron to fall. Injuries sustained in this fall may qualify the injured victim to file a premises liability claim or lawsuit in order to seek financial damages.

Would you like to learn more about premises liability claims? Our Personal Injury Law Firm can talk to you about your legal options and your ability to recover money that will help you begin rebuilding and moving on even during difficult times. Your initial consultation is free, and we take on all types of premises liability claims in the area, including:

Slip and fall accidents
Trip and fall accidents
Injuries from falling objects
Construction site injuries
Dog bites
Negligent security

Recovering Money for a Premises Liability Claim
In some situations, it may be difficult to successfully prove property owner liability in a claim of this kind. You will need to prove that the owner of the property was responsible in some way, and if there is no evidence to support this it may be increasingly difficult to get the money you rightfully deserve. This is why it is important to consider working with a premises liability attorney who has the resources to properly investigate your claim and build an aggressive legal strategy that represents your side of the story. Our Personal Injury Law Firm can provide you with the level of legal counsel you need in these cases.

PRODUCT LIABILITY

Product liability claims result from defective products. The claim involves the liability of anyone involved in the manufacture of the product, from the manufacturer or design of component parts, to the assembling manufacturer, to wholesalers and retailers.

Food, blood drugs, medical devices, appliances, automobiles, tobacco, a bicycle — if any product contains an inherent defect that causes harm to the consumer, some party in the chain of manufacture, distribution and final sale may be liable. If so, you may be entitled to compensation.

Product liability claims are based on any combination of three theories, or counts: negligence, breach of implied and express warranty, and strict liability.

In a product liability case, the product must be proven defective. For a product to be considered defective, it must have either design defects, manufacturing defects or defects in marketing. It is irrelevant if anyone in the manufacturing and distribution chain exercised great care to prevent injury — what is relevant is if the product contained a defect that caused harm. (This is called a strict liability.)

Product liability law is expansive, incorporating both individual injury and massive class-action lawsuits. If you’ve been injured by a product, please contact our Personal Injury Law Firm today!

RAILROAD ACCIDENTS

A railroad accident can be catastrophic causing injuries to the driver and passengers, and exposing the general public to hazardous materials. These accidents are almost always deadly and many lives are often affected.
Common reasons for railroad accidents:

Unprotected railroad crossings
Mechanical malfunction
Engineer error

The first step after a railroad accident is determining fault. If the train owner or operator acted negligently — even in the case of indirect damage — a railroad accident attorney at our Personal Injury Law Firm will help you obtain the largest financial settlement possible.

RAILROAD ACCIDENT FREQUENTLY ASKED QUESTIONS
I heard that railroad accidents are governed by different laws than other accidents. Is this true?
While it is true that the Federal Employers Liability Act (FELA) governs injuries occurring to on-duty railroad workers, not all lawsuits involving railroad accidents are brought by employees against the employer railroad.

Can I bring a successful wrongful death claim against the railroad if a relative was killed because he was on the railroad tracks?
Just because your relative was on the tracks does not mean that the railroad operator, conductor, or company were not negligent. The success of a wrongful death claim depends on what facts are available. Our experienced railroad accident attorneys will know how to file your claim after your initial consultation.

What rights do I have if I have been injured in a train accident?
Any person or any entity responsible for a train accident can be held responsible for the injuries they cause.

SPINAL CORD INJURY VICTIMS

If the brain is the control center for the body, the spinal cord is the means by which messages are sent back and forth, controlling bodily function, movement, and also the sense of feeling. When the spinal cord is injured, no matter how slightly, this may result in lasting damage that will affect a person’s ability to move, control his or her body, and perform daily activities. This is why spinal cord injuries are one of the most severe types of injuries a person may sustain.

At our Personal Injury Law Firm, our experienced attorneys assist clients throughout Texas who have suffered spinal cord injury in an accident or as a result of medical malpractice or a defective product. We can handle all types of personal injury claims in this regard, even those that stem from intentional wrongdoing, as in the case of an attack or assault. About Spinal Cord Injuries
Depending on the case, a spinal cord injury may result from physical trauma that damages the vertebrae in the spine or the surrounding tissue or blood vessels. A car accident, motorcycle accident, truck accident, slip and fall, trip and fall, or sports accident may cause damage to the spinal cord. Typically, a victim will suffer from weakness and sensory loss at and below the point where the spinal cord is damaged. The extent of damage the spinal cord suffers may vary from mild to severe and will affect the body accordingly. Some consequences of spinal cord injury may include:

Difficulty breathing
Loss of normal bowel/bladder control
Loss of feeling
Pain
Weakness
Partial or complete paralysis

TRAUMATIC BRAIN INJURY

Traumatic brain injury, or TBI, is a complex physical injury that may have a broad range of symptoms and associated disabilities. Because the brain is the control center of the body, the impact on an individual and his or her personality, memories and ability to perform day-to-day activities may be severe. A traumatic brain injury may result in lifelong medical care or the need for assisted living. Many injuries to the brain are currently incurable.

According to the United States Centers for Disease Control and Prevention (CDC), approximately 50,000 people die from traumatic brain injuries each year, and another 85,000 suffer from long-term disability. In the United States today, it is estimated that over 5.3 million people are living with traumatic brain injuries. That number only includes patients admitted to hospitals for treatment, not those treated in an emergency room or doctor’s office.

What Causes a Traumatic Brain Injury?
There are three main causes of traumatic brain injury in the U.S.: vehicle accidents, firearm injuries, and falls. In any of these three categories, a victim may have grounds for a personal injury claim against the person who caused the incident. In the case of a car accident, truck accident or motorcycle accident, it may be another driver or even the manufacturer of an auto part if this led to the accident. In cases involving firearms, intentional wrongdoing may be grounds for a personal injury claim. For slip and fall or trip and fall accidents, or falls related to construction sites or the workplace, you may be able to file a workers’ compensation claim against your employer or a lawsuit against the owner of the property where the accident occurred.

Regardless of your particular case, our Personal Injury Law Firm can meet with you to talk about your case and your options in taking legal action. It is our goal to help you recover the financial compensation you need to rebuild your life.

INVOLVED IN A TRUCK ACCIDENT?

Have you or someone you love been injured in a truck accident? At our Personal Injury Law Firm, our attorneys are dedicated to helping those individuals who have been injured or who have lost a loved one in trucking accidents. In these cases, a victim may be able to bring a civil lawsuit against the party who caused the accident, whether this is the driver of the truck, the trucking company, an auto part manufacturer, or another driver. Depending on the particular situation, a truck accident victim may be able to recover financial compensation for medical care, lost earnings, property damage, and much more.

With the support and legal representation of a competent and professional lawyer who has the resources to fully investigate every angle of your accident and injuries and the experience to build an effective legal strategy, you may have the opportunity to recover complete financial compensation. The value of a specific truck accident claim will vary depending on the specific accident, particularly on the extent of injury sustained and the impact the injury or injuries will have on various aspects of the victim’s life. It is true that this money cannot erase all traces of the collision or actually “compensate” a victim for what he or she has had to experience. It can, however, help him or her start the process of rebuilding and moving on to a more secure future.

Truck Accidents Are Common
Truck accidents are traffic accidents that involve one or more large trucks, vehicles that have a gross total weight of 10,000 or more pounds. Some commercial trucks may weigh up to 80,000 pounds or more and may be up to 75 feet long and over 8 feet wide. As you can imagine, any collision between a large truck and another vehicle has the potential to be catastrophic, causing serious injury to any parties involved and resulting in extensive damage to the smaller vehicle. The party most likely to be injured in a collision with a large truck is the occupant of another vehicle or any non-occupant involved, such as a pedestrian or bicycle rider.

Trucking accidents may have different causes, similar to the leading causes of all traffic accidents throughout the U.S.: driver negligence, speeding, drunk driving and driving while distracted. Trucks may have the added risk of a collision caused by an improperly loaded or overloaded truck, poor truck maintenance or poor road or weather conditions. The large size and weight of a truck makes it more easily impacted by heavy weather and hazardous roadways, as well as by negligent actions on the part of the truck driver or other drivers on the road.

CAUSES OF TRUCKING ACCIDENTS
A truck accident may be caused by one or more of three primary factors: negligence on the part of another driver, negligence on the part of the truck driver or trucking company or external factors (heavy weather, defective truck part, etc.) Were you injured in truck accident caused by any of these factors? If so, our Personal Injury Law Firm can help. We are dedicated to helping victims and families of victims recover the financial compensation they deserve.

Following are some examples of causes of trucking accidents:

A motorist driving in a truck driver’s blind spot for an extended period of time;
A motorist changing lanes abruptly in front of a large truck;
A motorist bringing his or her car to the right of a truck that is making a right turn;
Improper merging on a highway or freeway by the truck driver or another motorist;
Unsafe or improper passing;
Speeding;
Drunk driving;
Driving while distracted;
Driving a truck that is overloaded or improperly loaded, making it more difficult to maneuver;
A truck that is improperly maintained;
Defective truck or auto parts;
Heavy weather, such as wind, fog, snow, rain or hail; and
Dangerous road conditions.

No matter what caused the truck accident that led to your injuries, it is important to involve an attorney. Even if you feel responsible for causing the collision, you may be surprised to find that it was actually the other driver’s fault or may be attributed to some factor outside of your control. An attorney experienced in handling truck accident claims can properly determine what caused your accident, what your claim is worth and who should be held accountable.

Knowledgebase / Personal Injury Attorney – A Quiz to See If You Need an Attorney

When is a personal injury attorney in order? It’s not always easy to tell. Different lawyers handle different types of cases. You have to know which lawyer you need in which situation. If you’re injured, you probably need a lawyer that specializes in dealing with injury cases to represent you in court. How do you know if you need one of these lawyers? Take the short quiz below to find out.

Question One. Were you hurt while alone in your own home because of your own carelessness or negligence?

Answer: If the answer is yes, then you do not need an attorney. If you cause your own injury, then there is no one for you to sue. The fault is all yours when you cause the accident. The answer would have been different if the accident had been caused because of the negligence of someone else’s negligence. For example, if a company made a faulty grill that exploded and caused you to burn yourself, then you could possibly have a case against the company. Even if the injury occurred in your home, the accident was not your fault and the company may be liable for your injuries.

Question Two. Do accidents that happen at work count?

Answer: Usually, worker’s compensation will compensate you for injuries suffered on the job. If you have a difficult time getting the compensation, then you can call in an attorney. The attorney will be able to cut through the red tape and find out why you’re not getting your money. There are some jobs that don’t provide worker’s compensation at all. If that’s the case, then you’ll definitely need a lawyer to help you receive compensation if you’re hurt on the job.

Question Three. Should you hire any attorney that will accept the case?

Answer. No, you should not just hire any lawyer you can find. If you need a personal injury attorney, that’s the type of attorney you should contact. Don’t take a chance by hiring an attorney that handles many different types of cases. Pick the person that has the most experience in the personal injury field.

These questions and answers should help clear up some basic issues that arise when you are injured and considering a lawsuit. Be sure to ask your potential lawyer all the questions you need before you decide to hire him or her. Your representation is the most important part of the case, so be sure to hire the right lawyer.

There’s no reason you should be embarrassed about needing a personal injury attorney. Our personal Injury Lawyers are competent, trustworthy, and successful lawyers for your personal injury case. Join the thousands we have already helped by visiting us now.

How Personal Injury Compensation Can Help When We Can’t Rely On Others

We live in a very complicated world, a world where we are required to interact with others in order to function and to lead fulfilling and productive lives. We rely heavily on others. Even though we may pride ourselves on being self-sufficient, outgoing and a self-starter, we simply cannot do everything that we have to do without some kind of interaction.

We rely on our parents or guardians and teachers in our younger years and the way that they behave toward us can have a profound impact on our later lives. When we become an adult and begin working in a career, we rely on interaction with our employers and fellow employees, or with clients and customers, in order to make a living.

Outside of the work environment, we rely on the behavior and actions of others as we travel or visit other public places
We may feel rightly proud about the way that we behave and the care and attention that we devote to others, but can we expect most other people to do the same?

As you can see, we are relying on a lot of people to do a lot of things and it’s hardly surprising that sometimes things do go wrong. The world being the way that it is, people can fall down on their duties to act responsibly and with proper care and attention at all times and can be negligent. This negligence can often lead to serious repercussions and may result in you being injured, contracting an illness, or even dying as a result.

Personal Injury Compensation

Circumstances that could cause a situation making it necessary to file a claim for Personal Injury Compensation
You could sustain an injury at work caused by the negligence of a fellow employee. You could contract an illness if you were exposed to a substance erroneously. You could be under so much stress in the work environment that you could contract a psychological illness that needs significant treatment.

As sad as it is to say, you can suffer long-term psychological impairment as a result of abuse that you received when you were a child. You could suffer some other kind of psychological impairment if you were the victim of a particularly harrowing crime. We have to travel on our busy roadways in order to get from place to place and to do what we have to do. Traffic accidents are frequent and you could suffer significant injuries as a result of someone else’s negligence on our highways.

When you look at it this way it’s a wonder that we can summon up the courage to go about our daily business. However, it’s good to know that we can pursue legal action in order to make up for any losses that we may receive at the hands of somebody else. Personal injury compensation can be a complicated field to understand. It is therefore in your best interest to consult with an experienced attorney, who will be able to advise you of your best course of action and help you to calculate just how much compensation you should be looking for.

==============================gtg

Why You Should Always Consider A Personal Injury Claim

If you have been unlucky enough to have been involved in an accident or incident caused by the negligence of some other party, you may feel aggrieved. It’s simply not fair that you should have to put up with the inconvenience, the pain, and the anguish to say nothing of the financial repercussions associated with this action. You may feel anger at one moment and despair at the next. You don’t know how you’re going to make ends meet until you are able to recover from the injuries you have sustained. You don’t know how you’re going to be able to pay for the damages in this particular case. The other individual or organization may be denying responsibility and you may feel particularly annoyed that they would take this position. After all, in your eyes, it’s all clear-cut.

A lot of emotions are welling around inside you at these times. Few of us are legal experts who may have first-hand knowledge of what to do in these situations. Thankfully, injuries caused by others don’t generally happen to the same person on a regular basis and this may well be the first time that you have experienced this discomfort. You may find you have no response whatsoever when you approach the other party to see what they’re going to do about the situation. Lodging a formal complaint may be one way of showing that you’re displeased, but will it really lead to any concrete action? An apology is one thing, but you’ve suffered some significant losses, pain, and anguish, it’s therefore quite understandable that you should be seeking some form of compensation.

In cases like these, you should consider filing a personal injury claim through the legal system. You can claim compensation in two distinct areas. First, you can look for what is known as general damages and these will be payments made as compensation for the pain and suffering, or for a loss of earnings going forward. Secondly, you can look for special damages to cover the actual financial losses that you have incurred so far. These will include for example medical expenses, costs of repairing your property that was damaged in the incident, and so on.

You have two years to file a claim
It’s always a good idea to consult with experts in this field, who will help you to navigate your way through the process and also help you to calculate how much compensation you should be pursuing. You should know that you can discuss no-win, no-fee agreements with your legal representative. In many cases, your attorney will take on your case on this basis meaning that you don’t have to pay them any legal fees for their services.

In truth, many of us would like to avoid any interaction with the legal system if we can help it. However, unfortunate situations like these may arise and you certainly need to be looking after your best interests.

Understanding The Intricacies Of Personal Injury Law

For the layman, it can be very difficult to navigate your way through our legal system and to understand exactly what each particular law entails. It is, after all, not necessary for us to become legal experts as we go about our daily business chores and that is why we are able to turn to solicitors, who take the time and effort to go through law school and conduct regular research to keep up with all these complex subjects. Personal injury law can be a very complex subject by itself, but it’s good to know that our legal systems cover all eventualities and can come to our aid if we are unfortunate enough to be involved in an accident or incident which caused us such an injury.

The law allows us to claim reasonable compensation when we have been injured as a result of some other party’s negligence. Apart from the fact that we have to do whatever we can to minimize the losses that we sustained as a result of the incident, we can pursue the other party in a court of law for compensation to cover our past, present, and future losses.
You have two years from the date of the incident to bring a case to a court of law.

You will be able to claim general and special damages under two categories. These will cover you for the actual losses that you have sustained up to the date of the hearing and also cover you for pain and anguish, loss of amenity, and other considerations. Each particular incident may be different from any other, as the consequences will vary according to the circumstances of the individuals involved. Therefore, there is no such thing as a “standard” amount of compensation and so many different circumstances and factors have to be taken into consideration. This is why it’s important to consult with a solicitor who is experienced in this field. While on many occasions reference will be made to case law and to other “similar” cases, your position may be quite different and the losses that you may have incurred, and are likely to incur, could be truly substantial.

No amount of research that you may do yourself online can make up for the first-hand knowledge and many years of experience of a solicitor who is qualified and competent in this area of specialty. Don’t rely on Google searches to try and provide you with the information that you will need in order to be successful in your claim against the other party. Remember also that the goal is to try and reach a settlement with the other party without having to go to court. Do you feel confident taking on this challenge by yourself? You may have enough to cope with as it is with the injuries, discomfort, and financial issues. Don’t hesitate to talk with a qualified solicitor and ask them whether you can move forward with this case on a no-win, no-fee basis.

==========================gtg

Why Consulting With Personal Injury Lawyers Could Be Such A Good Idea In Your Case

Why should you consult with a solicitor when you have been injured due to someone else’s negligence? It may seem to be very ‘cut and dried’ to you – the other party was clearly negligent and you may feel as if you have witnesses that can help you prove this. Shouldn’t you be able to merely communicate with the other party and get the rightful amount of compensation for your hardship? Unfortunately, we don’t live in an ideal world where these situations could be settled by a handshake, an apology, and an appropriate amount of compensation. Unfortunately, it can be quite a lot more complicated than that.

Take, for example, a situation where you’ve been in a car crash
Somebody else may have run into the back of you when you were stopped at a red light minding your own business. They may have been distracted, not paying attention or there may even have been some failure with a braking system. The net result is the same, your vehicle was damaged, and so were you. In these situations, the insurance companies are now involved. One of the first things that they tell their clients is not to admit responsibility, even if it was plainly their fault. Thus, the other driver will refer you to the insurance companies and this may turn into a long-winded affair.

In many cases, the insurance company involved will want to dispute the compensation that may be payable and want to minimize their exposure. They have very competent legal representation on their side and they do this kind of thing all the time. It may well not be as straightforward as you might have thought, therefore, to try and get a rightful amount of compensation in your case, by yourself is not a good idea.

Personal Injury Compensation

Sometimes, insurance companies are not necessarily involved. At times like these, you might have to pursue the individual or entity concerned for compensation as a result of their negligence and these situations may be even more complex. You could find that trying to navigate your way through a process of making a complaint and seeking compensation by yourself can be just as much of a pain in the neck as the actual pain in the neck that you received during that rear-end collision. This is why you should talk with personal injury solicitors who have considerable experience in helping people like yourself to get the compensation that they so rightfully deserve.

You shouldn’t delay an approach to a personal injury attorney. You may well be tempted to approach the other party to try and make a complaint yourself and see if you can get compensation, but in the vast majority of cases, you may find that your request falls on deaf ears. A formal approach should be conducted by your attorney to help you to navigate a claim all the way through the legal system if necessary. Sometimes these cases have to go to court, but in many cases, a competent attorney on your side will be able to help you settle this before that happens.

How To Make Accident Law Work In Your Favor

If you’ve been unfortunate enough to have been injured as a result of an accident then you have certain obligations. For example, if this happens at work, you are duty-bound to report it and the first place you should turn in this case is normally the accident book which the majority of employers are required to maintain. Your employer will want to know all the details involved as they are in turn required to report such incidents to the Health and Safety Executive in most cases. A lot of information is gathered here to try and ensure that these accidents don’t happen again, as well.

If you are injured as a result of a traffic accident, it has to be reported to the police. This is an important part of accident law and will also help to determine who is at fault, who may be prosecuted as a result, and/or who may be found to be responsible for the payment of compensation in a qualified court of law.

You should remember that any accident that causes injury will usually have repercussions. The other party may be found to be criminally negligent for example and this might involve a complaint being brought to bear against that party by the criminal justice system. However, quite apart from such situations, you will invariably find that you may need to take action yourself to get compensation for the injuries, loss of earnings, and pain and anguish that you have suffered as a result. This is why it’s important to make some of these formal reports, to get documentation to help back up your case.

You need as much evidence as you can possibly gather, photographs from the scene of an accident, the details of eyewitnesses, and statements made by them. While you may be comforted by the presence of law enforcement at the scene of the accident, or by the attention given to your situation by safety personnel or trade union representatives at work, understand that you must take the responsibility yourself for gathering the information necessary to safeguard your position.

As soon as you can, consult with a personal injury attorney who is experienced in accident law relevant to your case. You can never have too much information in this situation. Once again, you should not rely on official reports or the interests of relevant government officials. Some of the reports that they are able to provide could be advantageous when it comes to your pursuit of compensation, but the information that you gather may well constitute the primary basis of your case.

It’s understandable that you may be dramatically affected, stressed, and preoccupied in the immediate aftermath of an accident causing injury. It’s important that you do whatever you can to guarantee the integrity of the relevant information and ensure that eyewitnesses are immediately contacted to make sure that they will come forward to help you at some future date.

By taking the right action at the moment of the incident you can help to ensure that accident law will come to your rescue, and help support you down the road.

The Personal Injury Process

#1 Personal Injury Attorney Search
In this part of the process, the client makes a decision to hire a personal injury lawyer who will represent them for the case.

#2 Legal Investigation into Personal Injury Claim
This process includes gathering the photos from the accident scene and interviewing all of the witnesses involved with the case. The lawyer will also obtain a medical release to bring together all records of suffering. The client initial interview will take place during this stage. The interview will allow the personal injury attorney to get a social security number, date of birth, address, names of witnesses, insurance companies, and other pertinent data from the client.

#3 Injury Settlement Negotiations
Before the case goes to court, the other party will typically try to negotiate a settlement with the client. A proposal will be sent along to the client’s lawyer, and they will evaluate the terms and compensation claims. If the proposal is accepted, then the process stops here.

#4 Preparing for Personal Injury Lawsuit and Filing of Lawsuit
If the settlement proposal is not accepted by the client, then the lawyer will prepare for litigation. At this point, the defendant will be notified of the lawsuit that has been placed.

#5 Defendant Response and Discovery
The defendant will have 20 days to file an answer and/or another responsive pleading. Then the discovery stage begins, which allows both parties to gather information from each other.

#6 Medical Examination by Defense and Oral Deposition
The defense will usually ask to examine the plaintiff with one of their doctors, and they will also ask for all medical records. During the oral deposition, the plaintiff and the witnesses will be interviewed by both sides under oath.

#7 Mediation and Personal Injury Trial
A mediation must occur before trial. During mediation, A neutral mediator attempts to get both sides to compromise on a personal injury settlement. A series of offers and counteroffers are exchanged during the mediation. If mediation fails, then the parties will proceed to trial. Trials range in length based upon the complexity of each case. At the conclusion of the trial, a judgment will be entered. If the Plaintiff prevails, then the Plaintiff will receive monetary compensation.

Emergency Room Error

In the unfortunate event of a medical emergency, you need to rely on hospital emergency room care to treat your injuries or save your life. Unfortunately, medical errors and malpractice happen more frequently than they should. If you received incorrect medical treatment and your condition became worse, or if you lost a loved one due to an emergency room error, it is important to find an experienced emergency room malpractice attorney with proven results to represent you in your claim.

Some common emergency room errors include:

Inaccurate diagnosis of a patient’s illness
Prescribing the wrong medication
Misreading tests or X-rays
Failure to order the proper tests

Sometimes patients come into the emergency room with serious medical conditions like strokes, meningitis, or heart attack, but are mistakenly diagnosed with a less serious illness and sent home. Medical errors like these can be fatal and can be grounds for a wrongful death claim. Another common error is when a doctor prescribes the wrong type of medication or wrong dosage or fails to give adequate instructions upon discharging the patient. Emergency room errors also happen if a doctor misinterprets a patient’s test results and x-rays, leading to incorrect medical care. Sadly, these preventable errors can result in serious injury or death.

Bicycle Accidents

People come to Texas from all over the world to enjoy our beautiful scenery and wonderful weather. It’s no wonder people like to get out and bike—yet there are very few dedicated bike paths. Most bicyclists have to risk sharing the road with cars.

For hundreds of bicyclists every year, taking that risk results in serious injury. Vehicles pull out in front of cyclists before the biker has a chance to stop. Cars hit bikers at corners when they fail to double-check that they have room to turn. Cars and trucks even run over bicyclists. For many bike riders each year, a bike ride ends in death.

Don’t let a bicycle accident derail your future. Hire an attorney with the experience and skill needed to get you the fair compensation you deserve. E-mail our Law Office or call toll-free for a free initial consultation.

Common bike accident injuries include knee and leg injuries where a car collided with the biker, collarbone and shoulder injuries if the cyclist hit the hood or windshield of a car and brain injuries caused by a cyclist being thrown into the roadway.

WHAT IF THE BIKER WASN’T WEARING A HELMET?
Under Texas law, bicyclists aren’t legally required to wear a helmet. However, if you suffered a head injury and you weren’t wearing a helmet, you could be found “comparatively negligent” for your injuries. That means that you have some degree of fault for the severity of your injury. Your final settlement could be reduced by the amount of fault assigned to you.

WHO WILL PAY THE BILLS?
If the bicyclist also owns a car — or the injured biker was a child and someone in the household owns a car and has insurance — your personal injury protection (PIP) policy on your car insurance is intended to cover your medical bills. If you do not own a car, the PIP coverage of the person who injured you typically covers your injuries.

The Dangers of Bicycling and Bike Accident Statistics

Bicycling is a great form of exercise. When you get on and begin peddling one generally thinks of the fun, the fresh air, the company, and the scenery. You might also be thinking of how many calories you’re burning and how great you’re going to look because you are performing this exercise.

One thing you are more than likely not thinking is of the danger lurking around the next corner. Bicycle accident dangers abound in today’s cities, but they could be anywhere. There are some unusual occurrences that lead to bicycle injuries but there are few injury causes that are more common.

• Drivers not paying attention to a cyclist
• Drivers failing to yield to a cyclist
• Drivers opening vehicle doors without looking first
• Commercial vehicle negligence
• Defective bicycle parts

As shown, most of the common bike accident dangers are human negligence in nature. In order for bicyclists to be truly safe, there needs to be a combination of occurrences such as better bicycling paths, improved driver’s education, and improved laws to protect the bicyclist.

Here are a few laws that currently exist in many states:

• Drivers should pass on the left side of cyclists allowing a safe distance between them
• Drivers will not park or drive in bicycle lanes
• When opening the doors of a vehicle, drivers and passengers will do so only when safe
• Drivers will exercise due care to avoid bicycle collisions
• Drivers will yield to a bicyclist making a left turn

Why is it so important to protect the cyclist? There are several reasons such as it’s a human right to be safe and protected, bicycling is a growing sport and we are likely to hear of more injuries if we don’t do something now, and the following eye-opening bicycle personal injury accident statistics:

• 846 bicyclists died in the United States in 2019
• Most bicyclist deaths in 2019 (90 percent) were those ages 20 and older.
• 2% of all 2009 traffic fatalities were bicycle deaths
• 93 bicyclists 15 years old and under killed
• 13,000 bicyclists 15 years old and under injured
• 41 years old is the average age of bicyclist death in the United States
• 31 years old is the average age of bicyclist injured in the United States
• The Consumer Product Safety Commission reports 417,485 emergency department-treated injuries associated with bicycles and bicycle accessories in 2019. This estimate includes both preventable and intentional injuries.

The numbers speak for themselves. The causes do as well. What about the cyclists? What about the injuries? These can range from mild to moderate to severe and even to death.

• Traumatic brain injuries (some recoverable, many not)
• Fractures (from simple to complex, recoverable to permanent impairment)
• Lacerations (simple cuts to major life-threatening)
• DEATH

Amputation

Tragically, car accidents or injuries from falling objects can cause serious injuries resulting in the amputation of a limb. Some common causes of injury leading to amputation include: being injured by heavy machinery, motor vehicle collisions, or having a limb crushed by a heavy object. An amputation injury lawyer can help you get the compensation you deserve for your injury.

Losing a limb in amputation can be a devastating event that inevitably changes your entire life. Normal daily activities such as walking, writing, playing sports, or taking care of oneself can become difficult or even impossible. Medical treatments and surgeries entail significant time away from work, and often the person is no longer able to fulfill his or her job duties. The result is considerably lost wages and difficulty finding a new job, which can often lead to financial hardship for the individual and for the entire family. In addition, the cost of medical treatment for an amputation injury is extremely high, and often expensive equipment, physical therapy, prosthetics, and multiple surgeries are necessary. Lastly, the injured person often must go through the pain and suffering from the initial accident itself, as well as the emotional ordeal of dealing with life and having to learn basic life skills all over again.

If you or someone you love has lost a limb in an accident due to another person’s negligence, our Law Office can help you seek justice and win compensation for your injuries. Premises Liability

SLIP AND FALL • TRIP AND FALL • INADEQUATE SECURITY
Property owners have the duty to make sure that their property is safe. Whether that means maintaining tight security or just keeping the floor cleared of trip hazards, any injuries caused by property conditions can be grounds for a premises liability lawsuit.

The injuries caused in premises liability cases can be disabling, traumatic, and even fatal. Make sure you find a lawyer you can trust to pursue and attain the settlement you deserve.

FREE CONSULTATIONS • ¡HABLAMOS ESPAÑOL!
For a free consultation at our Law Office, call us toll-free. You can also contact our firm online and we’ll get back to you as soon as possible.

Our attorneys have handled personal injury cases for many years. We are tenacious, reputable advocates. All clients receive their attorney’s personal cell phone number – and you can call 24 hours a day, 7 days a week.

INJURIES FROM INADEQUATE SECURITY
As the economy has tightened, the owners of apartment complexes, parking garages, and other properties have cut back on security as a way to save money. Of course, this is unacceptable – if they needed a security system before, why don’t they need one now?

There’s no real limit to the damage a criminal can do to a victim. Providing inadequate security is a blatant example of landowners putting profits before people.

“SLIP AND FALL” OR “TRIP AND FALL” ACCIDENTS
Restaurants, grocery stores, shopping malls, big-box retailers, motels … all of these places advertise to attract customers in droves. It’s their responsibility to make sure that their stores are safe. Slippery floors, poorly lit stairwells, cluttered hallways, and other hazards can endanger their customers’ health and lives.

If you’ve been injured, call toll-free for a free consultation to discuss premises liability lawsuits. You can also contact us online and we’ll respond shortly.

Spinal Cord Injury

Spinal cord injuries are among the most serious traumatic injuries that can occur, and the consequences on your life can be devastating. An experienced spinal cord injury attorney understands the nature of these injuries and can help you get the compensation you need and deserve.

Every year in the United States, there are about 11,000 people (30 per day) who suffer a spinal cord injury. Some common causes of spinal cord injuries are motor vehicle accidents, slip and falls, sports injuries, disease, or violent acts. Injuries to the spinal cord often happen after a traumatic blow that dislocates or fractures vertebrae in the spine. Some signs of a spinal cord injury can include: loss of muscle function, severe pain in the back and neck area, numbness, spasms, reduced sexual function, and/or incontinence. Sometimes a person who has suffered a spinal cord injury does not know he or she has a permanent condition and does little to treat it. However, in the case of a spinal injury, the patient needs specialized medical treatment for a successful recovery.

Unfortunately, spinal cord injuries are serious and often result in paralysis. Paraplegia paralysis means that the paralysis is in the lower body and legs, while quadriplegia paralysis refers to paralysis in the entire area below the neck. Individuals with spinal cord injuries often never fully recover and need special assistance for the rest of their lives.

If you or someone you love has suffered a spinal cord injury due to the negligence of another, it is crucial to find an experienced personal injury attorney who can competently represent you. Our Law Office has successfully represented clients for the past 20 years. Our spinal cord injury lawyers have won significant legal victories for clients who have suffered from traumatic spinal cord injuries.

At our Law Office, we always try to obtain the maximum level of compensation possible for each client. We believe in thorough preparation and we do extensive research of hospital records and work with medical experts to build the strongest case possible. We believe in providing the highest quality, proactive legal representation for you. Our initial consultations are always free, and all of our clients receive their attorney’s personal cell phone number so that they can feel free to contact him 24 hours a day, 7 days a week throughout the representation.

If you or a loved one has suffered a spinal cord injury because of someone else’s negligence, contact our Law Office right away. A PERSONAL INJURY ATTORNEY ON THE MEDICAL AUTHORIZATION FORM TRAP

Filing an injury claim is not like being charged with a crime. You don’t have to have a lawyer present with you during all the meetings with the insurance adjuster. However, you are absolutely entitled to have a personal injury attorney with you to make sure you’re not being subjected to stalling tactics. The popular trick used by many adjusters involves the medical authorization form. This is something that your personal injury lawyer should review before you sign on the dotted line.

The Medical Authorization Trap

When a claims adjuster requests you sign a medical authorization form, it would seem that is a standard form to fill out. However, your accident injury attorney might have a different opinion. That’s because some of these forms are “open-ended.” This means the adjuster can go on a kind of scavenger hunt looking for your medical records, whether that takes them two weeks or two years. You certainly don’t want to be waiting that long. You won’t have to when your personal injury lawyer can jump in and make sure that form has a deadline.

Your accident injury attorney might also point out that a medical authorization form provided by an adjuster allows them to search through all of your medical records. They should be reviewing the reports that are directly related to the injury for which you are filing your claim. An accident injury attorney will prevent adjusters from digging into your medical history where they don’t belong.

If you balk at signing a medical authorization form, a claims adjuster might state that you won’t get any type of payment unless you sign. An experienced personal injury attorney will know that is not always true, and in fact that the adjuster could be misrepresenting the policy.

Always Consult with Your Personal Injury Attorney

If an insurance adjuster calls you directly at any point in the claims process to ask you a question, your response should always be, “Let me talk to my accident injury attorney first.” The adjuster would prefer if you weren’t working with a lawyer so they can take advantage of your condition. Experienced lawyers with a background in accident/injury understand what you’re going through. Your attorneys should have experience in personal injury law and know all the “tricks of the trade.” Having them work on your case will bring you peace of mind, knowing things are being handled as they should. Call your legal team immediately to set up your consultation before you answer questions or fill out any forms.

How A Split Second Incident Can Leave You Searching For Whiplash Compensation

Apparently, the term “whiplash” dates back to 1928, when it was first used to describe a neck injury to soft tissue, in other words, a strain or a sprain. It has become synonymous with automobile accidents over the years and a common result whenever you have been involved in an accident where you were rear-ended. It’s important to be able to identify these injuries even though they may not be readily apparent.

You have to be aware of any kind of neck pain and maybe spells of dizziness which may occur days or even weeks after the accident. You could experience what is known as referred pain, i.e. pain in the back as well. Other associated issues could involve short-term memory loss, problems sleeping, and general malaise.

Where am I likely to sustain a Whiplash Injury?
While it’s certainly possible for you to sustain a whiplash injury elsewhere, the majority of these incidents seem to occur during relatively low-speed accidents on the road. You may be stopped at a red light for example and the driver behind is busy texting or paying attention to something else. He or she brakes too late and runs into the back of your car. What happens next may occur in the blink of an eye, but will invariably lead to some kind of discomfort or injury and start a chain reaction of events for you which could lead to inconvenience, discomfort, specialized medical bills, and leave you out-of-pocket.

How does Whiplash Injury actually Occur?
If you imagine yourself sitting in the car with your seatbelt on, the first thing that happens when you are rear-ended in this way is that your body, not connected to the seat will move backward slightly and then forwards. Remember that your head weighs quite a lot and is not restrained like your torso may be to the seat. Consequently, it will move forward and backward quite sharply and it’s this motion that causes the whiplash injury. Basically, the muscles and ligaments in your neck are being stretched and strained as they work to ensure that your head returns to its original position.

As we said, it all happens in the blink of an eye, in the amount of time that it takes for you to realize that you’ve been hit by somebody else in the first place.

The initial reaction is one of shock, of course, and then possibly anger. You are likely to want to jump out of the car to look at the damage and to talk with the driver involved. It’s important that you are aware of how you feel at that point and if you have considerable pain in your neck then you should call for medical assistance right away. Many people don’t become instantly aware of these injuries until sometime later, but you do need to be aware of what you need to do right at that moment. In order for you to claim whiplash compensation for the injury and potential future costs, specialized medical expenses, loss of wages, or whatever you may incur, you need evidence.

How Our Congested Roads Increase The Likelihood That You Will Have To File A Car Accident Claim

If you use a vehicle to travel a reasonable distance to work every day and may also use it to go on road trips to visit relatives or for other leisure purposes at weekends, it’s unfortunate that the odds are stacked against you. What does this mean? Sadly, the more miles that you rack up on your family car the more likely you are to be involved in an accident by the law of averages.

It doesn’t really matter whether you consider yourself, quite rightly, to be a first-class driver. You cannot always make up for the inefficiencies of the other person and you may simply be in the wrong place at the wrong time. We have seen what can happen when a driver becomes distracted by using his or her mobile phone or by texting. They say that if you’re texting whilst driving you are probably at least as impaired as a driver who has been drinking all night and then driving home.

Putting the potential risks of having a car accident into perspective
If we really sat down and thought about the potential danger we wouldn’t walk out of the house in the morning, of course. We have to go about our lives and driving is part of that for the majority of us. So long as you’re careful yourself you may well be fortunate enough not to be involved in a serious incident. However, you also need to know what to do in the event that you are.

If you’ve never done it before, you might not know how to file a car accident claim, or even be uncertain what you should do at the time of the accident. We should all know by now that it’s not prudent to claim that an accident may have been “your fault” even if you think that it is, so don’t expect the other driver to accept responsibility when he or she runs into you.

Ensure you collect evidence at the time of any accident situation as a matter of course
It goes without saying that the first priority in the immediate aftermath of an accident is to ensure that anyone who was hurt is tended to by medical professionals. In these situations, the police must always be present and you will get an official report from them. However, make sure that you get your own evidence if you can, including the names and addresses of witnesses. Pull out your mobile phone and take as many photographs as you can to document what happened as this will help you and your attorney to move ahead with your claim.

Consult with experienced attorneys in this area, if and when you’re unlucky enough to become one of those accident statistics.

Why You Should Always Consider Seeking Car Accident Compensation

Isn’t it amazing how complicated the typical automobile is these days? In the name of progress and efficiency, we are now driving vehicles that are way beyond our average comprehension, especially when it comes to trying to fix them. The average automobile mechanic has quite an array of sophisticated tools to help them whenever something needs to be done and it’s hardly surprising that it costs so much for us to take the vehicle in for repair these days. As if the cost associated with mechanical repairs were not enough, have you seen how much it’s likely to cost you for even minor repairs in the body shop? You might think that they’re making body panels for the typical family car out of gold these days, it costs so much to repair even the minor “fender bender.”

Like so many other things in life, it seems that we cannot do without our automobiles. Many of us commute to work and find it unrealistic to rely on public transportation. Isn’t it amazing that statistics show that the majority of cars on the road during rush hour are single occupant? Hardly efficient, certainly, but it just goes to show how much we rely on these vehicles.

It is true to say that modern cars are very reliable due to technological innovation and we shouldn’t have to worry so much about unexpected breakdowns anymore. So long as we take the car in for regular maintenance we may expect them to start up upon demand each morning. Everything is fine until something unexpected happens to rob us of the use of our vehicle.
The inconveniences you may have to suffer as a result of a Car Accident can be varied
When somebody else’s negligence causes an accident involving you and your car, there are almost always significant repercussions. It doesn’t take much to cause enough damage to render your car undrivable and you may be without its use for some weeks. While you may rely on your own insurance company to commence repairs right away, repair shops can be busy and backed up. You may well have to get a replacement vehicle and worry about all kinds of issues.

Hopefully, you were not injured in any way during the accident, but if so this may open up a whole new area of problems. You may have time off work to consider, medical expenditure, home help, and so on.

Consider the full implications of claiming compensation for a car accident
Maybe you don’t have to worry about the sheer cost of repairs to your car due to assistance from the insurance, but you might have to worry about deductibles and other implications. You may have to worry about finding alternative means of traveling to work and over time these additional costs can simply add up. When the incident was caused by somebody else’s negligence, it’s only right that they should pay.

Consult with a lawyer who is experienced in car accident compensation, who will be able to tell you what you’re able to claim for and how much you should seek. This can be a complex area and it’s not a good idea to try and take on the might of the other party’s insurance company by yourself.

PERSONAL INJURY LAW FIRM DEFINES PERSONAL INJURY

Personal Injury Claims
Generally, people file a lawsuit if they have been injured as the result of someone else’s actions, and in order to obtain compensation for their medical expenses, damages, lost wages, or other losses.

The most common personal injury cases involve automobile accidents, dog bites, and falls. But there are many other areas that are known as personal injury law.

Personal injury law is also known as tort law. A tort occurs when someone acts in a negligent manner that results in injury or damage to another.

In general, negligence is the failure to use due care. Due care is the degree of care that a reasonable and prudent person would use in similar circumstances.

In general, a plaintiff in a tort action must show a defendant was negligent to be able to recover damages. Defendants may allege that the plaintiff was negligent, and contributed to the damages suffered.

Other areas of tort law are more refined. For example, in medical malpractice actions the plaintiff must prove professional negligence; in other words, that the medical provider failed to use that degree of care that a reasonable and prudent medical provider would use under similar circumstances. There are also cases where a defendant may be liable if someone is injured absent negligent conduct by any person. Those types of cases include when a person is bitten by a dog without provocation, in defective product claims, or when persons are injured when a defendant undertakes a highly hazardous activity.

DO I HAVE A CASE?

Personal Injury Claims
A personal injury claim may be filed based upon various different types of accidents or other incidents that stem from negligence or wrongdoing. Auto accidents, including car accidents, motorcycle accidents, truck accidents, pedestrian accidents, and bicycle accidents, are the most common grounds for personal injury claims throughout the U.S. Additional types of claims may include, but are not limited to slip and fall accidents, defective products, medical malpractice, dog bites, and boating accidents. Our Personal Injury Law Firm handles all types of personal injury cases, and we offer a free initial consultation to talk about your case and how we can assist you.

ASBESTOS INJURY

Asbestos is a soft fibrous mineral used to make fireproof material and insulation. Exposure to asbestos has been linked to serious illnesses, most notably mesothelioma, cancer. Now – adult children of workers who were exposed to asbestos are becoming sick, as well.

Generally, asbestos claims are filed against the company responsible for the property where the asbestos exposure took place — an employer or a home builder. Claims seek workers’ compensation for asbestos-related injury.

As the link between asbestos and serious illness continues to emerge, more asbestos claims are finding their way to trial. Asbestos is dangerous, and if you’ve suffered health problems as a result of exposure, compensation is available.

Negative health effects as a result of asbestos exposure manifest themselves in a variety of ways. The only way to know for sure is to go see a doctor who has a thorough background in asbestos-related injury.

Our Personal Injury Law Firm understands the medical nature of asbestos claims, as well as the legal precedent set regarding similar claims. Contact us today — we’ll help determine your best route towards financial compensation.

INVOLVED IN A AUTO ACCIDENT?

The bureaucratic process following an auto accident can be as chaotic as the accident itself. Insurance companies, medical providers, police, and other drivers, can be difficult to deal with – having adequate legal representation can help.

Insurance companies have teams of lawyers working for them. Their goal is to limit the amount of your settlement. From lost wages to long-term medical bills, there are numerous areas of settlement that you may deserve, yet be denied.

Our Personal Injury Law Firm will help you get the largest settlement possible.

AUTOMOBILE ACCIDENT FREQUENTLY ASKED QUESTIONS
What should I do if I have been involved in a car accident?
If you have been in a car accident or any type of vehicle accident, the first thing you should do is make sure that you are okay. Get out of your car, and make sure that other passengers are able to get out. You also need to exchange information with the other driver. This includes name, address, phone number, driver’s license number, license plate number, as well as insurance carrier and number. Try to get the name, address, and phone number of any witnesses, too.

What information should I give to the other driver?
Only give the information listed above. DO NOT say anything that may imply blame. For example, don’t say, “I’m sorry, I wasn’t really paying attention,” or, “I was talking on my cell phone and didn’t see you.” Just give the driver your personal information and wait for the police to arrive.

What damages can I get from a car accident claim?
If you were not at fault for your auto accident, you may be entitled to damages beyond the repair of your car. You may also be reimbursed for medical expenses, lost earnings if you missed work, as well as compensation for pain and suffering.

Should I talk to an insurance adjuster?
Under no circumstances should you talk with anyone from the insurance industry until you speak with a car accident lawyer. If the insurance adjuster who wants to take a statement from you is from your insurance company, you may have an obligation to give them a statement. However, it is best that you speak with your lawyer before you do that. Under no circumstances should you give any kind of statement, verbal, in writing, or recorded to an insurance adjuster from the company representing the other party. You should always remember that insurance adjusters are under tremendous pressure to settle claims as quickly and as cheaply as they can. The insurance adjuster for the other party does not have your interests in mind. Often, your own insurance company will not have your interests in mind particularly if it will be necessary for you to file an insured motorist claim against them.

If you’ve been in an auto accident, be sure to document everything, sign nothing from the insurance company, and contact our Personal Injury Law Firm right away.

DANGEROUS DRUGS

Although the FDA (Food and Drug Administration) regulates medicine and prescription drugs manufactured, distributed, and sold in the United States, it still occurs that dangerous drugs are broadly released that result in serious side effects and even death. If you or a loved one has been injured in any way as the result of a prescription or over-the-counter drug, it is important that you consult an attorney to determine whether you have grounds for a lawsuit.

A drug injury professional attorney at our Law Firm can meet with you to talk about your case. We understand that you may have suffered a serious illness that has affected many aspects of your life. Our attorneys believe in holding the responsible parties accountable for their actions in this regard, and our Law Firm also believes that the action we take now can also serve to protect others in the future.

Claims and Lawsuits from Dangerous Drugs & Side Effects
The manufacturer of the drug or perhaps the doctor who prescribed the drug to you may be held liable (legally responsible) in civil court for their actions, meaning you can recover financial compensation for medical care, lost wages, and possibly much more. All of this can allow you to rebuild your life and move on, which is usually the primary concern on our clients’ minds. Our Personal Injury Law Firm offers a free initial consultation to talk to you about what side effects you or a loved one suffered, what drug you took, who prescribed it, etc. This will give us an idea of whether you may have grounds for a lawsuit. There are many different potential causes of motorcycle accidents, and with our experience in handling these we will fully investigate your case to determine its cause and who should be held responsible. It may be that another driver simply “didn’t see you” or that a defective motorcycle part caused the accident. Your motorcycle accident lawyer at our Law Firm will take the time to determine exactly what was involved with your crash in order to protect your legal rights to the fullest extent of the law.

Motorcycle Injury Lawyers Serving Texas
The injuries sustained in a motorcycle accident are most often serious, typically to the rider of the motorcycle rather than the occupants of the other vehicle. The rule of thumb in any traffic accident is that a vehicle of a smaller size and weight will sustain more damage, and for a motorcycle, this means that the rider or riders will often experience the brunt of that damage. Injuries from a motorcycle accident may affect one’s ability to work and overall quality of life, leading to extensive emotional trauma as well as financial difficulties, only compounded by the stress of having been involved in the accident itself.

Fortunately, an experienced attorney can help you rebuild and recover after sustaining a catastrophic injury in a motorcycle accident. By bringing a lawsuit against the driver or whatever other party may have caused the accident, our Personal Injury Law Firm can seek financial compensation for medical care, loss of earnings, emotional trauma, future loss of earnings, future medical care, and possibly much more. You can start moving on with your life; it starts with involving an attorney.

AFTER A MOTORCYCLE ACCIDENT

Although the specific actions you should take after a motorcycle accident will vary depending on the particular situation, there are basic actions that you can take if you are involved in an accident of this kind.

First and foremost, it is important that you remain at the scene. You will need to report the accident and take other actions, and leaving the scene of a motorcycle accident is actually a criminal offense in Texas.
Assist anyone who has been injured, which is more than likely in a motorcycle accident.
Make sure you call 911 so the incident is reported to the proper authorities, who will most likely arrive at the scene if someone is injured.
Exchange driver and insurance information with the other driver or drivers who were involved in the accident with you. This is also a requirement under Texas law, just as it is to remain at the scene.
Seek medical care even if you feel that you are not seriously injured, as at times injures may present themselves in hours or even days.
If possible, take pictures at the scene and get the information of any witnesses who saw what occurred.
Take notes of everything you recall, and keep detailed records of any treatment you receive or work you miss.
Report the accident to your insurance company.
If the other driver’s insurance company approaches you or calls you in order to get a statement, refrain from signing anything or making a formal statement. They will most likely only be attempting to get you to say or do something that will limit their client’s liability.
One of the most important steps to take after a motorcycle accident of any kind is to contact a motorcycle accident lawyer as soon as possible. Involving our Personal Injury Law Firm early in the process may go a long way in enhancing your ability to reach a positive outcome.

Medical Malpractice

Medical doctors, nurses, and other hospital staff usually provide competent, correct medical care and treatment. Unfortunately, there are times when the care provided falls below the standard of care and a patient suffers devastating injury or death as a result. The injury may leave the patient unable to return to work and facing further medical treatment and bills or their death may leave their family without an important wage earner.

Unfortunately, given the powerful lobbying and media efforts of the insurance industry and medical providers many people have been led to believe that medical malpractice cases simply benefit “greedy trial lawyers”. They forget that the primary beneficiary is the injured person or their family. If the insurance industry had its way, good people who undergo tragic consequences to them or a loved one due to medical errors would be left without an adequate remedy. That is why, despite the efforts of the insurance companies and medical interests, the law provides that victims of medical malpractice are entitled to bring their case to a jury to seek full and fair compensation from those responsible for their injuries. The alternative is to leave permanently injured or disabled people to become a burden on the state and its taxpayers. Medical malpractice cases not only provide critically needed compensation but also serve to encourage hospitals and other providers to improve their treatment and avoid future mistakes.

When we put our trust in a medical professional, clinic, or hospital, we expect them to provide the appropriate level of care required by our medical condition. We certainly do not expect them to allow or make the problem worse or for a new problem to be caused by the medical provider.

Examples of Medical Malpractice include:

Giving a Patient the Wrong Drug and other Medication Errors
Failure to Diagnose a Medical Disease or Condition
Birth Injury
Surgical Errors
Failing to Conduct Necessary Tests
Studies have shown that as many as 100,000 people a year die from medication errors made by medical providers. Deaths from surgical and other negligence add even further to that total. If you feel your condition or that of a family member was created or worsened due to the actions of a medical professional, it is important to speak with our medical malpractice lawyers in Cleveland.

Nursing Home Negligence & Abuse

When loved ones get older, they may need someone to take care of them. While they may not need hospital care, home care may be unaffordable. Moreover, with the pressures and obligations that come with everyday life, it may be difficult for their family to personally give them the care they need. Because of this, a nursing home is often the only option. When a family member is entrusted to a nursing home, the family is putting their faith in the nursing home and the professionals working there. They assume that the home will take good care of their loved ones. While most of the time this is the case, it is not always so, and sometimes elderly individuals in nursing homes are neglected or abused.

Nursing Home Negligence or Other Abuse Can Lead to:

Bedsores
Failure To Diagnose Medical Conditions
Prescription Drug Errors
Dehydration
Falls or Other Injuries
Eating Complications
Poor Hygiene

Unfortunately, nursing home patients may be subjected to negligent care. While this may not be intentional abuse, it is careless, below the standard of care for what is required of the nursing home, and can result in injury or death to the patient. However, other forms of nursing home abuse exist as well and can include physical abuse, mental abuse, and financial abuse. If you feel your loved one has suffered from any type of nursing home abuse, contact a lawyer for advice.

Are you unsure if your loved one is being abused in their nursing home? In many cases, an abused patient may be too afraid to say anything to their family due to threats from staff or just due to the fact they have experienced a great amount of trauma. There are signs to look for. If unexplained rashes, abrasions, bruises, cuts, or other marks start to appear on their body, personal belongings are missing, or there is a sudden change in their emotions, there may be a reason to investigate further. Contact a nursing home negligence lawyer if you suspect your loved one is being abused in a nursing home.

Do you believe your loved one is being abused or suffering due to staff negligence in a nursing home? A lawyer can help! Contact our Nursing Home Negligence Lawyers today to schedule a free consultation.

Pedestrian Accidents

People walk for many different reasons. Some people walk to work. Others walk for recreational purposes or to get exercise. Others take young children out for walks or walk their dogs. Unfortunately, a simple walk outside can result in serious injury or death when a negligent driver makes a wrong decision and strikes a pedestrian. Contact a lawyer if you or a loved one were injured by a negligent driver as a pedestrian.

A pedestrian accident can result in:

Disability
Bone Fractures
Disfigurement
Brain Injury
Death

Every year in the United States, motor vehicles kill approximately 6,000 pedestrians. This means that every day 16 people are killed in a pedestrian accident. The number of pedestrian injuries is even more alarming. There are approximately 110,000 pedestrian injuries each year in the United States!

Due to the fact that pedestrians are more vulnerable compared to those in a car, bus, or truck, the results are much more devastating for the pedestrian. Drivers must be aware of pedestrians while they are driving and avoid negligently injuring them. A pedestrian accident lawyer can help if someone close to you was struck by a vehicle and injured or killed.

Premises Accidents

Whether you are at work, on vacation, or just running everyday errands, property owners have certain duties that vary according to the factual circumstances to make sure that your visit is safe and you leave uninjured. When the property owner fails to meet their duty and a serious injury occurs, the property owner may be held accountable and the injured person obtain fair and just compensation for their injuries. It is imperative to contact our premises liability lawyers if you feel a property owner’s negligence was the cause of your injury.

The following are situations that may give rise to a premises liability case:

Lack of Security
Dangerous Property Conditions
Lack of Maintenance
Negligent Staff
Most business owners know about their legal duties and responsible owners take out adequate liability insurance to cover any such injury. Damages may include medical costs, pain and suffering, loss of wages, and permanent injury.

Unfortunately, to try and protect their profits, insurance companies often deny responsibility that the company they insure is responsible for these damages. Sophisticated insurance adjusters try to minimize the amount of compensation a seriously injured person may be lawfully entitled to receive. Contact our Premises Liability Lawyers if you feel your injury should have been prevented by the property owner.

Have you or a loved one been injured on someone else’s property or business premises? Our lawyers can help you determine if you have a claim and then pursue that claim on your behalf! Contact our Premises Liability Lawyers today to schedule a free consultation.

Railroad Accidents

Railroad accidents happen more frequently than people think. These types of accidents can be catastrophic and produce deadly results. railroad accidents can occur for a number of different reasons. Many times, however, it is the fault of someone other than the injured person. If you feel your railroad accident was the fault of another, contact our lawyers.

Throughout the country, including Texas, the most common types of railroad accidents are:

Lack of Security
Dangerous Property Conditions
Lack of Maintenance
Lack of Adequate Inspections

According to 2020 statistical data, Texas ranks as number 1 for railroad collisions in the United States with 186 collisions, 11 deaths, and 67 injuries. Unfortunately, many railroad workers are hurt and killed every year in Texas due to the carelessness of others.

The cause of a railroad accident can be the result of numerous things. In some cases, the railroad company may be at fault. For example, lack of training, failing to properly maintain the train and/or the tracks can result in accidents such as derailments. Finally, failing to have properly working lights, gates, and other warnings at railroad crossings can result in a terrible railroad accident.

Train Accident Attorneys

Did you know that a train accident occurs in the United States every 90 minutes? It is a true and alarming fact. Many of these train accidents are the fault of the railroad and not the motorist.

However, a railroad claims representative will attempt to persuade you into believing a motorist is always at fault without providing the underlying facts such as the train black box which shows the speed of the train and whether the horn was being blown, the employee time reports, and daily track inspection reports. Even if you were provided with this information, you must seek INDEPENDENT legal advice to evaluate the information in a fair and unbiased form. Some of these train accidents result in injuries that range from mild to severe, while others result in severe brain damage or other catastrophic injuries, or death. Letting the railroad get off the hook by not taking them to task when they are at fault will allow the railroad to continue to operate unsafely and lead to other injuries and deaths.

It is well-established law that railroad companies owe a duty of reasonable care to provide for the safety of the public and its employees. Railroads must also comply with state and federal laws, rules, and regulations concerning employee and public safety. Contrary to what the railroad would have you believe (for example, “train accidents are always caused by the motorist” or “the motorist failed to yield” or “the railroad employee caused their own injury”), courts and juries have many times found railroads responsible for causing injuries and death to the public and their employees.

Some of the factors that lead to injuries and deaths at railroad crossings are solely under the railroad’s control. These factors that place the public in danger include failing to install lights and gates at the crossing, failing to remove vegetation and trees that block the view of an oncoming train, overworking train crews, faulty railroad crossing signals, and insufficient employees to properly maintain the track and equipment.

Most crossings in the United States are not protected with flashing lights and gates. Instead, these railroad crossings are protected only by signs and are known as “passive” railroad crossings. Proper warning devices such as lights and gates are readily available and can be easily installed by railroads. Hazardous conditions such as multiple high-speed tracks, view obstructions, a history of multiple accidents, heavy school bus traffic, and hump or high profile crossings exist throughout the country. We believe railroads should be protecting these crossings with lights and gates in order to meet their duty to protect the public and their employees.

Railroads that choose to turn a blind eye to unsafe conditions must be held accountable for the sometimes tragic consequences of their choice. Otherwise, they will continue to disregard their duty to protect the public and their employees.

Train accident statistics reported by the Federal Railroad Administration (“FRA”) include the following:
HIGHWAY RAILROAD CROSSING ACCIDENTS

In one year there were approximately 1,381 reported deaths and injuries at highway-rail railroad crossings;
On average a total of 4 people per day are either killed or injured at highway-rail railroad crossings in this country ;
In one year there were approximately 150,000 public highway-rail railroad crossings in the United States;
In one year only about one out of four (26%) of the 150,000 public highway railroad crossings in the United States were protected by gates.
In one year about 54% of the 150,000 public highway railroad crossings in the United States were protected only with a sign.
A driver is 30 times more likely to die in an accident that involves a railroad train rather than another motor vehicle.

Whether you or a loved one was injured in a railroad crossing injury, derailment, or another type of train accident, or if you lost someone close to you in a railroad accident due to the negligence of another, call our train accident attorneys. We are here to help and answer your questions.

Spinal Cord Injury Attorneys

Every year throughout the United States, many individuals are involved in accidents that result in a spinal cord injury. In fact, annual statistics show that there are approximately 11,000 spinal cord injuries each year in the United States. A spinal cord injury is a severe, life-altering injury that can leave someone physically unable to do things they were once able to do. In many cases, the spinal cord injury results from the negligence of another individual.

The most common cause of spinal cord injury is car accidents. Aside from car accidents, spinal cord injury can also result from:

Slip and Fall
Acts of Violence
Disease
Recreational Activities

Loss of movement (paralysis) over some part of the lower and/or upper body and permanent disability is the usual result of a severe spinal cord injury. Our attorneys are here to help if you or your loved one suffered a spinal cord injury in an accident due to the negligence of another. Even when the spinal cord injury does not result in paralysis, other severe results such as cracked, damaged vertebrae, separated discs, and pinched nerves, can accompany such an injury.

In some cases, a spinal cord injury may seem somewhat trivial, only causing mild pain. However, it is still important to get the necessary medical attention because more severe repercussions may surface later on, resulting in more pain, greater injury, and more costly medical bills. Medical care, nursing costs, tests, equipment, and medications are all some of the things our attorneys can help you get compensation for, as well as pain and suffering. Speak with our attorneys today if a careless person or company caused your spinal cord injury.

A Detailed Guide To Traffic Tickets And Violations Associated With It

Millions of traffic fines are handed out every year in America. The National Highway Traffic Safety Administration states that the average penalty is $150. However, depending on where the violation occurred, motorists can be fined up to $2000 in some states. In the US, there are driving responsibility programs in Michigan, New Jersey, and New York. These programs establish systems that assign points for moving violations and apply penalties to offenders according to the type of violation. Drivers who are convicted of an offense under certain laws could be charged separately. The high fines each state imposes on drivers have made the traffic ticket system a multi-billion-dollar business that generates billions each year.

What is Traffic Violation? How does this happen?

A traffic violation is different from a traffic law infraction. Infractions are not crimes and often come with a fine. Infractions are generally non-moving violations or non-dangerous violations. These constitute the majority of traffic citations. Even though each state has a different definition, a traffic violation is considered more serious. This is usually considered a crime. More severe violations can be classified as misdemeanors or felony traffic violations, depending on their severity. These offenses include driving under the influence (DUI), reckless driving, hazardous driving, driving without insurance, and failing to stop at an accident scene.

Individuals are entitled to receive legal protection when charged with a misdemeanor, felony violation, or any other crime. Individuals charged with a misdemeanor or felony violation will be subject to a booking and bail procedure, as well as the right to a trial in front of a judge or jury. A serious violation is when an offender causes or threatens to cause damage to property or people.

A minor offense under the law may include driving even after seeing a stop sign. A pedestrian may be struck by a vehicle if the driver ignores a stop sign. This offense could be a misdemeanor or even a crime depending on how serious the accident was. A driving ticket will be issued to anyone who has been involved in a hit-and-run accident or committed multiple DUI offenses.

Here is a list of all the information included in traffic tickets.

A charge that you violated traffic laws, including the part that is being alleged as infringed.
Name of the traffic law or the reason for which the ticket was issued, if applicable.
Details of the event of that specific hour and in that particular place on that particular day.
Name and address of the person to whom the citation will be sent.
Identification information about the vehicle, including make, model, and license plate
Information about how to contest or dispute the accusation. This includes the name and address where the location is located.

Each state has its own traffic laws. It is important that you are familiar with the traffic laws in the state where you reside or were cited for the crime.

The Most Common Moving Violations

A moving violation is when a vehicle in motion violates traffic law. These are the most common moving violations:

Driving at speeds higher than the allowed speed
Speeding through stop signs or red lights
Failure to stop for a school bus or on approaching a pedestrian
Taking a u-turn in the wrong direction.
Unlawful taking over of another vehicle
Driving in a carpool lane without permission
Neglecting to give the right-of-way

A driver’s license may be suspended or revoked depending on the severity and frequency of the violation. License suspensions can be applied for a range of periods, from a few weeks to several years. Here are some examples of serious violations in moving:

Driving a vehicle even after your license has been suspended
Driving recklessly or in dangerous ways
DUI (driving under the influence of vehicle)
Highway intimidation
Racing on the street.
Motor vehicle murder

The penalties could include imprisonment and a significant fine, depending on whether the driving offense is a misdemeanor or a felony. The person could be charged additional insurance premiums that can reach hundreds of dollars.

The Non – Moving Violations :

A non-moving violation is, in most cases, illegally parking your car, getting a “fix-it” ticket to repair defective equipment, or making illegal modifications to your vehicle. They are not on your driving record and are assessed at a lower rate than a moving violation.

The most common offenses in non-moving violations are:

Parking in front of a fire hydrant.
Parking in a prohibited zone
Parking in front of a meter that is not functional
Parking and blocking the walkway.
Parking on two levels
Parking in an accessible spot without a placard or disability plate issued by the Department of Motor Vehicles

A parking ticket is issued to the vehicle and not the driver. This is different from a moving violation. If you fail to respond to a parking ticket within a specified time, a notification will go to the registered owner of your vehicle asking for payment.

Your vehicle could be towed and then seized if you fail to pay your parking fines. Drivers with six or more outstanding fines may not be eligible to renew their licenses in certain states. Your driver’s license and your vehicle registration may both show a non-renewable status.

Each state and city has its own laws regarding the correction of a non-moving offense. Some states will require proof of correction. Others may allow you to send your signed ticket and correction proof along with your dismissal fee to avoid appearing in court. You should consult the local laws to determine the corrective actions to take. The directions are usually written on the reverse side of the ticket.

Searching For A Traffic Lawyer Made Easy With 6 Quick Pointers

In the past five years, one in five Americans received traffic tickets. Are you, by any chance facing a traffic violation that could result in a fine or a more serious offense? If yes, it is better you consider hiring a traffic ticket lawyer. Contrary to other offenses, you don’t have the right to retain the services of a traffic ticket attorney. You will have to pay out of your pocket to hire a traffic ticket lawyer.

This blog article will discuss some of the things you should consider before hiring a traffic ticket lawyer. So stay tuned!

1. The Cost Of The Ticket

Depending on the severity of your offense, the ticket cost may be lower than the amount you would need to pay to have a lawyer defend it at trial. This may be enough motivation for some people to pay the ticket instead of contesting it in court.

But, the downside is that it will be added to your criminal record for up seven years, depending on the severity of the offense and where you live. If you feel it is worth it, you can opt to hire a lawyer. This is especially important if you face multiple violations and additional penalties like the suspension or loss of your driver’s license.

2.The Experience & Expertise Of Your Lawyer

You should ensure that your lawyer has experience with traffic fines before you hire them. You should ask specific questions to determine if a lawyer or firm is right for you. A lawyer who is experienced and has managed a considerable number of similar cases will be the right choice for you. The number of cases they have fought, especially those that were successful, is often a deciding factor in choosing a lawyer.

3. The Cost

Although attorneys will not usually give you an exact figure of how much you will have to spend on your case, it is important to understand what they think the cost will be so you can plan accordingly. Some lawyers will give you a precise amount right away. This amount can be more than the cost of the ticket. However, it is sometimes justified, especially when the traffic ticket is for criminal offenses.

4. The Type Of The Ticket

You will definitely need a lawyer to assist you in getting your traffic ticket dismissed. A person who isn’t a lawyer can’t effectively defend themselves in court and argue for the dismissal of a traffic ticket. An attorney can increase your chances of success.

Your lawyer might be able to help you reduce the penalty for a traffic ticket. They can also help you lower the points on your record and reduce your fine. They may be able to assist you in negotiating other arrangements, such as the completion of a diversion program for your points or the penalty to be removed from your record.

You will have to plead guilty and go to a traffic school if you are found guilty. This could also lead to a monetary penalty in certain cases. After you complete this task, all points you earned will be deleted from your record. You won’t have to worry about losing your license or having other problems in the future.

5. Online Reviews

Reading reviews online can be beneficial in determining if a lawyer is right for you. To see what others have to say about the lawyer, you might want to check out some reviews on Google and other websites that review lawyers. A lawyer’s track record of having positive reviews is a good indicator of their quality.

6. Attending Court Hearings

Consider whether you would like your lawyer to represent you in court without you being present. You may not be required to attend hearings in many cases. Your lawyer will negotiate with court officials in your absence. If you wish, however, you can choose to attend. In some cases, attorneys may be able to contract with other lawyers to represent them at traffic court. It is important to find out who will represent you in court and what information they have about your case.

How Bicycle accident lawyers can help

Representative cases

Our Law Firm is one of the oldest and most respected plaintiff’s personal injury firms in Texas. For over 20 years, our bicycle accident lawyers have dealt with cases involving serious injury and fatalities involving bicycles, and have secured judgments for their clients that have enabled them to live with security and dignity. Some of these individuals had suffered serious physical injuries including brain damage and spinal cord injury. Other clients have been families in which a loved one suffered a wrongful death in a bicycle crash.

Bicycle accident by the roadside
Our accident lawyers have successfully represented persons who have suffered bicycle injuries and families who have lost loved ones in bicycle crashes throughout Texas.

As bicycle accident lawyers, we seek to relieve clients of anxiety and uncertainty about their cases. We work closely with each client to make sure we understand their needs and concerns, and to see that those issues are addressed so that the client can be completely focused on his recovery and his family. Because we have handled so many bicycle injury cases, we are able to lay out a course of action that will take a client to the conclusion of their case with minimal anxiety and stress. The most helpful service our accident lawyers can render their clients is to prosecute their case aggressively, helping them achieve the fairest monetary result we can obtain. At the same time, we try to help our clients return to the life they enjoyed before the collision.

When our Law Firm takes on a bicycle injury case, a senior bicycle injury attorney assumes responsibility for the case and assembles a legal team of attorneys, investigators, paralegals, and other staff to investigate and research the case. We strive to understand all that occurred in the crash, to carefully assess the evidence, the site of the crash and surrounding area, and all relevant circumstances. We evaluate the quality and functioning of the bicycle and of safety equipment, especially helmets. We review medical records to determine the full extent of the injury. We will look first at your medical needs, to assure that you are getting the appropriate medical care and the rehabilitation you need.

Competitive bike rider
Our bicycle accident lawyers are committed to a thorough and accurate investigation for any client on whose behalf we undertake representation. Unlike most personal injury firms, we have a full-time investigative staff that we can deploy to thoroughly investigate every reasonable claim. In cases involving bicycle injury, gathering the facts and evidence as soon as possible can be critical to the success of a case. We offer prospective clients unparalleled resources to accomplish the necessary investigation.

We recommend these important actions after a bicycle crash to protect your rights:

Get the information you need whether or not police are present, you’ll need to get names and contact information for any witnesses, and secure driver’s license and insurance information with all drivers involved.
Notify your insurance carrier. As soon as you can, contact your insurance carrier and tell them about the collision. Be sure to cooperate fully with your insurance company.
Know the Statutes of Limitation These laws limit the time by when one must file a claim or a lawsuit. It is important to know which statutes apply to your particular circumstance. It is wise to contact a bicycle accident lawyer very soon after the crash in order to make sure that your rights are not forfeited, and that you can pursue your civil remedies.

Start the Investigation. It is crucially important for the investigation of the crash to begin while memories are fresh, and before critical evidence at the collision scene has been removed, washed away, or otherwise eliminated.
Our bicycle accident lawyers employ three full-time accident investigators who will travel throughout Texas to help find vital evidence for our lawyers and secure it for your case. While you are receiving medical care and recovering, you may not feel ready to have your case resolved, yet evidence collection needs to be underway. Our investigative staff can obtain factual statements, scene photographs, accurate measurements, and collision photographs, leaving you to focus on your recovery and return to the quality of life you enjoyed before your injuries.

F.A.Q. FREQUENTLY ASKED QUESTIONS ABOUT DOG BITE AND DOG ATTACK INJURIES

HOW FREQUENT ARE DOG BITE AND DOG ATTACK INJURIES?
The US Center for Disease Control reports that every year more than 4.7 million Americans suffer a dog bite injury. Of these, nearly 800,000 require medical attention, and about one percent of dog attack victims require hospitalization for their care.

WHAT IS THE RISK OF DOG BITES FOR CHILDREN?
About half of all children in the US will be bitten by a dog before they are 18. Seventy percent of the victims of serious dog bites and dog attack injuries who require hospitalization are children, and about 70 percent of those who die from dog bites are children.

ARE CERTAIN GROUPS AT HIGHER RISK FOR DOG BITES AND DOG ATTACKS?
The elderly have a higher rate of dog attacks, as do service workers such as mail carriers, other delivery persons, meter readers, home health aides, and others who make house calls, and are therefore more exposed to dogs.

IS THE FREQUENCY OF DOG BITES INCREASING IN THE US?
Dog bites are increasing faster than dog ownership. Between 1986 and the present, dog ownership increased 2 percent, and dog bites requiring medical treatment increased 36 percent.

ARE SOME DOG BREEDS’ BITES MORE DANGEROUS?
More than half of all documented serious dog attacks in the US involve Rottweilers or pit bulls.

HOW CAN I REDUCE MY RISK OF A DOG ATTACK?
Do not approach dogs you don’t know well, nor those unaccompanied by an owner. Avoid packs of dogs. Do not provoke or tease any dog, whether you know it well or not.

WHAT AGE GROUPS ARE MOST ARE MOST AT RISK FOR DOG ATTACKS?
Children 14 and under are the most frequent victims of dog attacks. Seventy percent of fatal dog attacks and
more than half of bite wounds requiring medical attention involve children. Among children, the group suffering the highest incidence of dog attacks is 5 to 9-year-old boys. Dog bite injuries are the third leading cause of emergency admission of children to hospitals.

ARE THERE PSYCHOLOGICAL EFFECTS FROM DOG ATTACKS?
The emotional trauma resulting from being attacked by a dog is a central element in many dog bite cases. People often suffer from post-traumatic distress disorder, with symptoms of sleep disturbance, flashbacks of the attack, severe anxiety and irritability, impaired concentration, and persistent fear of dogs.

WHO IS RESPONSIBLE WHEN A DOG ATTACKS AND INJURES A PERSON?
Under Texas law, dog owners are liable when their dog bites someone, and the attack victim does not have to prove fault or negligence. This law does not apply to a person who is bitten while trespassing.

DO HOMEOWNERS AND RENTERS INSURANCE COVER DOG ATTACKS?
The Insurance Information Institute, an insurance industry group, states that homeowners’ and renters’ insurance policies typically cover dog bite liability. Most policies provide $100,000 to $300,000 in liability coverage. If the claim exceeds the limit, the dog owner is responsible for all damages above that amount, including legal expenses. However, some carriers are now excluding certain breeds from coverage.

ARE SUPPORT GROUPS HELPFUL FOR DOG ATTACK SURVIVORS?
A support group of other dog attack survivors can be invaluable. People who have experienced what the new survivor is experiencing can help a dog attack survivor deal with persistent psychological symptoms. Other survivors can help a new dog attack victim find a way to live with scarring and come to believe that that the future is worth working towards. Many dog bite and dog attack survivors also make use of psychotherapy to help them deal with the challenges of this period.

Personal Injury Lawyer

When a person has been injured due to the carelessness of another, they have the right to file a case against that person and to be reimbursed for medical expenses, loss of wages, and other damages that result from that injury. We are a personal injury Law Firm that devotes the majority of our law practice to representing clients who have suffered a personal injury caused by someone else’s negligence. Many of their cases are motor vehicle accidents that have resulted in serious injury.

They have successfully represented clients in cases that range in settlement value from a few hundred dollars to a few million dollars, with equal dedication and commitment. No case is too small or too large for them to devote their time and resources.

Causes of Personal Injury
A personal injury, depending on the severity of the victim’s injuries, can result in ongoing rehabilitation, permanent disability and much unnecessary suffering. The most common types of personal injury cases result from:

Car accidents
Drunk driving accidents
Truck accidents
Motorcycle accidents
Pedestrian accidents
Construction accidents
Dog bite injuries
Evidence and Witnesses
In order for a personal injury lawyer to effectively represent your case, they must be able to obtain and present valid evidence of the cause and result of your injuries. This material is discovered by the exceptional, professional, and exhaustive resources that our Law Firm employs for the investigation of each of their cases.

They also locate and interview any witnesses who can testify to the events leading up to and including the client’s injuries. Expert witnesses are also called to testify as to the validity of the circumstances and evidence presented in each case.

Accurate Records
Our Law Firm will also employ the use of professionals to review and clarify the accuracy of any records relating to a personal injury case. These may involve victim records, medical records, eye witness accounts, and any other relevant material that will aid in building a successful case representing their client.

If you are the victim of a personal injury, it is very important that you record daily events, thoughts, feelings, and conversations relating to your injury so that you can supply this information to your personal injury lawyer. These items document how your injury has affected you physically and mentally. They will also aid your lawyer in representing you accurately, even if the case lasts for several months or longer.

Motor vehicle accidents account for more personal injury claims than any other type of accident. Our Law Firm of auto accident lawyers dedicates the majority of their legal practice to representing victims who have been involved in some type of motor vehicle accident. We know and appreciate how important the health and happiness of your family are, and we will work hard to get you the compensation you deserve following a serious injury.

We want you to know that regardless of whether or not you are a legal United States citizen and employed, you are entitled to be heard in a court of law if you have been injured in an accident. Let our family help your family during this time. No case is too large; no case is too small.

Types of Motor Vehicle Accidents
The three major types of motor vehicle accidents include:

Auto accidents
Truck accidents
Motorcycle accidents
The cause, severity, and legal liability of a motor vehicle accident can all vary greatly depending on the specific circumstances surrounding each accident. While most accidents are the result of another person’s negligence, the severity of that negligence must be determined in a court of law in order to obtain a fair settlement for the injured party. It is in your best interests to retain legal representation as soon as you are able to do so.

Motor Vehicle Accident Expenses
Mounting medical bills combined with the loss of income, legal fees, and the cost of renting a temporary vehicle can grow into a massive burden that we make sure you do not face alone. Our cases are taken on a contingency basis, which means you don’t owe us a penny until we have won your case for you.

In the meantime, we will help you obtain a rental car if needed, pay your medical expenses and meet you at your convenience if you cannot come to our office. Our focus is on your health and healing and we will work tirelessly to obtain the justice and settlement you are entitled to.

Your Rights Following a Motor Vehicle Accident
It is very important that you file your accident report and any claims with the proper authorities and insurance carriers as soon as possible. Most states have a short deadline, after which you cannot file your claim.

If you are being contacted by an insurance adjuster representing the person at fault, please do not, under any circumstances, agree to any settlement or sign any papers before speaking with your attorney.

If you or someone you love has been injured or killed in a motor vehicle accident, it is your legal right to seek justice and to be compensated for your injuries. We understand the difficulties you face as a result of your accident, and we will make sure that the responsible party or parties are held accountable. Please contact the auto accident attorneys at our Law Firm today to schedule a consultation.

Bicycle Accident Lawyers

Many people own a bicycle. While some people bicycle for recreational purposes or for exercise, others depend on their bicycles as a form of transportation. Others cycle on a regular basis for competition. Additionally, many children enjoy bike riding. Most bicyclists understand the rules of the road and ride safely. Unfortunately, even when cyclists are safe and careful, drivers around them may not be. If a driver is negligent and hits a cyclist the resulting injuries can be devastating. If this happened to you or someone you know, contact our Bicycle Accident lawyers today. As with many accidents, it is important for the evidence, witness statements, photographs, and other investigative information to be obtained as soon as possible after the accident.

Have you or a loved one been injured in a bicycle accident? Our lawyers can help!

A bicycle accident can result in death or a number of different injuries, including but not limited to:

Bone Fractures
Paralysis
Spinal Cord Injury
Brain Injury
Concussion

Bicycling should be a fun, enjoyable activity with no worries. Sadly, because other people may make poor choices while driving, a deadly bicycle accident may result. The Texas Department of Transportation reports that in 2019 there were 2,554 bicycle accidents in Texas. Our lawyers are here to help if you feel your bicycle accident resulted from the actions of a negligent or reckless driver.

Many times, when a bicycle accident occurs, it is the fault of the driver in the vehicle. When drivers fail to properly yield, run red lights or stop signs, drive while intoxicated or drowsy, speed, or simply drive in a careless manner and don’t properly follow the rules of the road, it can lead to a devastating accident. If this type of driving caused you injury or led to the injury or death of a loved one you should obtain appropriate legal advice before entering into any discussions or giving any statements to the driver’s insurance adjusters. No matter what they say, the insurance adjuster for the driver has no duty to represent your interests and is probably trying to paint a picture that minimizes the carelessness of the insured driver. Our attorneys can assist you through this challenging and stressful process. Having a lawyer allows you to concentrate on other important matters such as obtaining the proper medical care or supporting others directly impacted by the serious injury or death.

Frequently Asked Questions

Q: How much does an attorney charge in a personal injury case?
A: Although this depends on the attorney, in most cases, personal injury cases are charged on a contingency fee basis, which means that the attorney does not receive any fee unless a recovery is obtained. It is important to know up front whether you will be responsible for any of the direct costs of investigating and pursuing your claim if the claim is not successful for some reason. Our Law Firm does not charge the client for any of the costs of the case unless the case is successful.

Q: Why don’t I just deal directly with the other party’s insurance agent and not hire a lawyer?
A: In general, insurance companies do not work for you. A negligent party’s insurance company is motivated by profit concerns and, therefore, wants to pay you as little as possible. The other party’s insurance adjusters are trained to minimize your recovery and have no duty to represent you. For example, they may have no duty to inform you of the applicable time limits for your particular claim. If your claim is not filed in a timely manner you can lose your rights forever. If you retain an attorney to represent you that attorney owes you a duty to represent your interest zealously and often can recover a much higher amount than the insurance company would offer to otherwise pay.

Q: Either myself or a loved one has been seriously hurt, or worse, and now I am being directed to a specific attorney to represent my legal interests. What should I do?
A: The decision to retain a particular attorney is an extremely important one. If you are the family member of a loved one that has been lost, there may be many legal issues to handle including setting up a probate estate so that a claim can be pursued.

Regardless of what you are told, the choice of an attorney is YOURS AND YOURS ALONE. You should not allow others to pressure you into choosing a particular law firm to represent you. If you do feel undue pressure it may be worth asking why the person feels so strongly about the law firm he is recommending. Is he or she recommending a particular firm because they have had a favorable and real first-hand experience with that firms’ representation or is it because he plays golf with a particular lawyer?

You should feel comfortable with the lawyer you choose to represent you. It is always reasonable to ask questions of prospective attorneys. Good attorneys will not be offended by this and in fact, should welcome the opportunity to discuss their previous experience and successes. Some questions worth asking are:
If I hire you, will you be the lawyer personally handling my case from start to finish or will you assign my case to someone else?
When was the last time you personally tried a case before a jury?
What are the strengths and weaknesses of my case? (You should question lawyers making promises of guaranteed outcomes).
Will you provide me with your personal cell phone number so that I can contact you outside of your office hours?
Will you have enough time to dedicate the necessary personal attention to my case? (You want to have a lawyer with a balanced caseload that allows him or her the necessary time to fully prepare for your case).
What is your experience with your firms’ advertising such as television, back of phonebooks, and/or billboards being used by opposing counsel to influence jurors at trial?

Q: How do I know if I have a potential lawsuit?
A: The best way to figure this out is by contacting a lawyer. Even if you think you may not have a case, it is very possible that you actually do.

Q: How is the value of my injury determined?
A: This depends on a variety of factors such as lost wages, pain and suffering, medical bills, emotional trauma, property damage, and more. Ultimately, if the parties cannot reach a fair settlement then a jury may decide what is required to fairly compensate you for your injuries.

Q: When should I file a lawsuit?
A: You should contact an attorney as soon as possible to determine this! There is a time limit on these types of cases, so you do not want to lose your legal right to recover damages.

Q: What is the procedure during a standard personal injury lawsuit?
A: In most cases, your participation is minimal. Pre-trial court appearances are usually not necessary. Often cases will settle without the need for a trial. Our lawyers explain what to expect to all of our clients and pride ourselves on our availability and keeping our clients fully informed.

Having a baby is usually one of the most exciting and joyous occasions that someone can experience. Unfortunately, medical professionals sometimes fail to do something they should have, or they do something wrong and things don’t go the way they should have. When this happens, a birth injury may occur. A birth injury can result in numerous problems for the baby, including life-altering disabilities, and even death. A lawyer can help if your baby was injured during the birthing process because of a negligent doctor or nurse.

Has your baby suffered from a birth injury or birth defect due to the negligence of a medical professional in Texas? A lawyer can help! Contact the Injury Attorneys at our Law Firm today for a free consultation.

A birth injury can result from:

Disease misdiagnosis
Inducing labor too late
Failing to perform a necessary c-section
Mishandling the infant, causing shoulder dystocia
Failing to properly recognize fetal distress
Although many birth injury cases involve the baby being physically injured during the birthing process, other cases involve babies being born with birth defects. How can a baby’s birth defect be the fault of a medical professional? In many ways. While some birth defects are out of a doctor’s hands, others could have been prevented or may have never occurred if it wasn’t for a doctor’s actions. For example, certain prescription drugs can result in birth defects. It is the doctor’s obligation to make sure that any drugs they are prescribing to their patient won’t complicate the pregnancy or put the baby at risk.

Two of the most common birth injuries are Erb’s Palsy and Cerebral Palsy. Cerebral palsy is often caused by brain damage and can result in learning problems, speech difficulties, and poor coordination. Erb’s palsy is a condition that affects any or all of the primary nerves in the arm and affects arm movement and results in partial or complete paralysis.

OUR FIRM PHILOSOPHY
As attorneys concentrating on serious injury cases we see firsthand the devastating effect that disabling injuries and the resulting financial hardships can have on an individual or family. Although we hear a lot in the media about greedy trial lawyers – this is often an image portrayed by insurance companies and other large corporate interests who would prefer to have sole control over the rights of those injured by their negligence. The work we do provides important corporate accountability for unsafe practices and helps provide some degree of financial security to families whose quality of life has been robbed by an avoidable serious injury. The power to decide whether someone should be compensated lies with our citizen jurors and should not be entrusted to the profit concerns of insurance companies or other corporate entities. People who are injured by the carelessness of others should not be abandoned. We are proud to be advocates for injured individuals in our American civil justice system.
